Carbon County court — DUI

Five defendants charged with driving under the influence were sentenced on Monday morning in Carbon County court by President Judge Roger N. Nanovic II. All previously entered guilty pleas to the charges.

The five were:

Dakota Charles Heintzelman, 22, of Jim Thorpe, was sentenced to serve 90 days to five years in jail, pay a fine of $1,500, license suspended for 18 months and supply a DNA sample.

He was arrested for DUI of a controlled substance on May 28, 2018, along Route 895 in East Penn Township, by state police at Lehighton.

He was denied house arrest placement and was ordered to serve the term on consecutive weekends by the court.

He was given credit for four days already served and will begin serving the remainder of his term on Feb. 11 at 6 p.m. He was granted work-release privileges.

Stephen A. Griffith, 53, of Lehighton, was sentenced to serve 90 days to five years in prison, pay a fine of $1,500 and his license suspended for 18 months. On a charge of driving under suspension - DUI related, he was sentenced to serve 90 days in jail and pay a fine of $1,000. The jail terms run concurrently.

He was arrested on Sept. 20, 2019, by state police at Lehighton along Dairy Road in Lower Towamensing Township. He was charged with DUI of a controlled substance and driving under suspension.

He was denied a weekend sentence and will report to the prison on Feb. 15 at 6 p.m. Nanovic also imposed zero tolerance for drug or alcohol use.

Nanovic noted Griffith has five prior DUI convictions.

Walter Eugene Spallone, 62, of Hazleton, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000 and his license was suspended for one year.

He was arrested on May 24, 2019, along Route 209 in Franklin Township, by state police at Lehighton. He refused a test.

He will begin serving his sentence on Feb. 11 at 9 a.m.

Daniel Dagorn, 64, of Lehighton, was sentenced to serve 30 days to six months in jail, pay a fine of $750 and one-year license suspension. He was given credit for 30 days already served and paroled.

He was arrested on Sept. 16, 2017, by Lehighton police along Bridge Street. A test revealed a 0.25 BAC.

Roberto Santiago Jr., 53, of Lansford, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000 and one-year license suspension. He was given credit for 24 days already served and paroled.

He was arrested on Jan. 15 by Mahoning Township police along Mahoning Drive. He refused a test.

Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole.

The delayed start of the prison terms is due to a COVID-19 flare-up at the county prison.
