Man charged after spitting/coughing, exposing self, and defecating on floor of state police barracks
A Kresgeville man faces multiple charges after spitting and coughing on police officers, exposing his private area, and defecating on the floor of a state police barracks.
According to the affidavit of probable cause filed by Mark E. Bower of the Pennsylvania State Police - Lehighton barracks, in the case against Gary Kauffmann:
At 4 a.m. Nov. 27, Bower and Trooper Charles Inserra were on routine patrol southbound on Route 534 at the traffic light on Route 209 in Polk Township when a white sedan made a right-hand turn from southbound 209 onto 534 and almost struck their patrol vehicle.
Bower also saw the vehicle had a burned-out passenger side headlight, a loud muffler, and something dragging on the undercarriage creating sparks.
Bower then turned his vehicle around and attempted to initiate a traffic stop on the white Honda Civic.
The vehicle was driving down the center of the roadway and failed to yield, at which time Bower followed the vehicle north on 534 and the vehicle turned left onto Bruch Road, where Bower identified the operator as Kauffmann, 36.
The vehicle then made a right onto Windy Hill Road, and continued onto Dotters Corner Road, all while committing multiple motor vehicle violations.
Bower attempted a PIT maneuver at Windy Hill Road and Dotters Corner Road, but it was unsuccessful, so he followed the vehicle onto Barry S. Road across 534 and made a left onto Bird Lane, where he attempted a second PIT maneuver, which was also unsuccessful.
The vehicle continued onto 534 and traveled south in the opposite lane of travel, and then made a right-hand turn onto Holly lane and pulled into Kauffmann’s home.
Kauffmann then got out of the vehicle and made furtive movements when asked to show police his hands, so Bower deployed his Taser, which was unsuccessful.
During this time, Kauffmann threw something into the woods that was not recovered.
Kauffmann was then taken into custody and while doing so spit into Bower’s face and mouth.
While in custody, Kauffmann purposely coughed into Inserra’s face multiple times, stating he had COVID-19.
Kauffmann also attempted to slip his handcuffs and take his seat belt off multiple times, and was then transported to PSP Lehighton, where he exposed his genitalia multiple times with civilians present and also ripped the walls down around the bench he was handcuffed to, causing damage to the drywall.
While in custody, Kauffmann also defecated on the floor.
Kauffman faces charges of aggravated assault; criminal mischief - damage property; fleeing or attempting to elude officer; DUI; recklessly endangering another person; indecent exposure; disorderly conduct; obedience to traffic control devices; failure to keep right; disregard traffic lane; duties at stop sign; turning movements and required signals; driving at unsafe speed; careless driving; reckless driving; have improper muffler; and failure to use safety belt - driver and front seat occupant.
He is currently incarcerated in the Monroe County Correctional Facility in lieu of $50,000 monetary bail, and scheduled to have a preliminary hearing Dec. 11 before District Judge Danielle Travagline of Tobyhanna.
