Carbon County court — DUI

An Albrightsville man entered guilty pleas to fleeing or attempting to elude police, a felony 3, and other counts on Thursday in Carbon County court.

He was one of 11 defendants in DUI-related cases to enter a guilty plea before Judge Steven R. Serfass.

Nesquehoning incident

Justin William Cannon, 28, who was arrested on Nov. 8, 2019, also pleaded to two counts of recklessly endangering another person and one count of DUI.

He was arrested by Nesquehoning police on Nov. 8, 2019. On the date listed police were dispatched to the New Columbus section of the borough for a report of a vehicle being driven erratically and speeding. Officers observed the vehicle in question along Columbus Avenue and attempted to make a vehicle stop. The driver fled and led officers on a high-speed chase that ended when he crashed his vehicle into a bank along West Catawissa Street. The driver was identified as Cannon. He was injured and taken to an area hospital for treatment and later charged.

He entered his plea via video from the county prison, where he is an inmate on the charges.

Serfass deferred sentencing and ordered the adult probation office to prepare a presentence investigation report.

Other pleas

Dustin Christoph Fierro, 24, of Philadelphia, was arrested on May 28, 2019, by Palmerton police along First Street for DUI of a controlled substance. He also pleaded to driving under suspension.

On the DUI count Serfass sentenced him to serve 72 hours to six months in jail, pay a fine of $1,000, render 25 hours of community service and license suspended for a year. On the suspension charge he was fined $500.

Daleann Hess, 55, of Larksville, Luzerne County, was arrested on July 24, 2019, along Route 534 in Kidder Township by state police at Fern Ridge. Given a test, the result was 0.12 BAC.

A first offense, she was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.

Wayne Brian Groff, 31, of Scranton, was arrested on June 24 by state police at Fern Ridge along Route 940 in Kidder Township. A test revealed a 0.18 BAC.

Sentencing was deferred so Groff can obtain a comprehensive drug and alcohol evaluation.

Richard Joseph Curro, 52, of Lindenhurst, New York, was arrested on Dec. 27, 2019, along Moseywood Road by Kidder Township police. A test revealed a 0.30 BAC.

Sentencing was deferred so Curro can apply for placement in the house arrest program.

Thomas Baldini, 29, of Lansford, was arrested by Lansford police on Feb. 28, 2019, along Patterson Street. He refused a test.

Sentencing was deferred so Baldini can obtain a drug and alcohol evaluation.

Mark Steven Holland, 54, of Jim Thorpe, was arrested on Jan. 21, 2017, by state police at Lehighton along Route 903, in Penn Forest Township. A test revealed a 0.17 BAC.

Sentencing was deferred so Holland can apply for the house arrest program.

Austin Gregory Homlak, 24, of Palmerton, was arrested for DUI of a controlled substance on Jan. 20 along Route 248 in Bowmanstown by state police at Lehighton. Troopers responded to a crash and found Homlak under the influence.

He was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, license suspended for a year and render 25 hours of community service.

He will began jail term at 9 a.m. on Oct. 23.

Travis James Husar, 32, of Palmerton, was arrested on for DUI of a controlled substance Nov. 30, 2019, by state police at Lehighton along Route 903 in Penn Forest Township. Troopers initially responded to a domestic incident involving Husar.

Husar said he addressed his addiction problem by successfully completing a inpatient rehabilitation program run by the Salvation Army.

Serfass sentenced him to serve 10 days to 24 months in prison, pay a fine of $2,500, license suspended for a year, supply a DNA sample and render 100 hours of community service.

He was given credit for time in the inpatient program and paroled.

John David Breitenbach, 53, of White Haven, was arrested on April 20, 2019, by state police at Fern Ridge along Interstate 80 in Kidder Township. A test revealed a 0.25 BAC.

Sentencing was deferred so he can apply for the house arrest program.

Donald Jay Cook, 53, of Kingston, Luzerne County, was arrested on March 28, 2018, along Lauchnor Road in East Penn Township by state police at Lehighton.

A first offense, he was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.

Sentencings

The following defendants previously pleaded guilty to DUI counts.

Matthew David Beers, 36, of Lehighton, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, license suspended for a year, render 25 hours of community service and make restitution of $3,786.26 for damages.

He was arrested on Dec. 1, 2016, along Catawissa Street by Nesquehoning police for DUI of a controlled substance.

He will begin the jail term at 5 p.m. on Oct. 30.

Jorge Angel Vega-Martinez, 26, of Tamaqua, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, license suspended for a year and render 25 hours of community service. He will begin the jail term on Nov. 5 at 11 a.m.

Vega-Martinez claimed he had already served the minimum three days. Serfass ordered the probation office to check out if he is entitled to any credit. If so, he does not have to report on Nov. 5; if not, he must report as ordered.

Drug count

Karl S. Hoffman, 44, of Lansdowne, Delaware County, pleaded to one count of possession of drug paraphernalia with a DUI charge dropped in a plea deal. He was arrested on July 22, 2019, by state police at Fern Ridge along Milton Way in Penn Forest Township.

He was placed on probation for a year and ordered to get a drug and alcohol evaluation and render 50 hours of community service.

Each defendant sentenced must also pay court costs of about $1,000, pay a $50 per month supervision fee while on parole or probation and follow any recommendation of their drug and alcohol evaluation.
