Man is charged with possession of marijuana

A homeless man will go to court after police found him with marijuana in a car that was reported stolen.

According to the affidavit of probable cause filed by patrolman Charles McFeeley Jr. of the Weatherly Borough Police Department in the case against Gabriel Hines:

On Sept. 22, McFeeley was patrolling the area of North Street near the intersection of Eurana Avenue when he saw a red Ford Explorer illegally parked against traffic with one occupant in the driver seat who appeared to be trying to duck when McFeeley drove by.

McFeeley turned around and saw one occupant in the vehicle, Hines, 18.

He ran the registration and saw the car was reported as stolen.

Hines was taken out of the vehicle without incident.

A strong odor of unburned marijuana emanated from the vehicle.

Pocono Mountain Regional Police confirmed the vehicle was stolen out of their jurisdiction.

A search of the vehicle was conducted and marijuana was seized, as well as the keys to the vehicle.

Hines was transported to the Weatherly police station, where he refused to provide a statement.

The marijuana was tested and came back positive for marijuana, and weighed in at 2.8 grams.

Hines faces charges of receiving stolen property, unauthorized use of automobile and other vehicles, and additional parking regulations.

He is currently incarcerated in the Carbon County Correctional Facility in lieu of $25,000 monetary bail. Charges were waived for court in a hearing before District Judge Joseph D. Homanko Sr. of Weatherly.
