Carbon man sentenced to state prison term on several charges

A Carbon County man was resentenced Monday afternoon to a state prison term after pleading guilty to several charges. His resentencing was due to him being “kicked out” of a state drug program in the state prison system.

Eric Pauloski, 38, of Albrightsville, appeared by video from the state correctional institution at Mahanoy, Schuylkill County, before Judge Steven R. Serfass.

In January 2019 he was placed in the then state Intermediate Punishment Program, which was an intensive drug treatment program in the state correctional institution system. He was then removed from the program for failure to follow the rules.

He previously pleaded to charges of theft, criminal use of a communication facility, simple assault, fleeing or attempting to elude police and criminal trespass. He was placed in the IPP on all the charges but warned at the time if he didn’t successfully complete it he would be resentenced.

Serfass resentenced him to serve a total of 36 to 72 months in a state correctional institution with credit for a total of 122 days spent in the county prison on the charges. Serfass said the department of corrections will determine what credit, if any, he will get for his time in the state IPP.

Pauloski admitted to attempting to strike an officer with his vehicle and then fleeing the scene and leading police on a high-speed chase. The incident occurred on March 17, 2018, and began in Jim Thorpe and ended up in Penn Forest Township.

According to the affidavit of probable cause filed by Detective Lee Marzen of Jim Thorpe, he was assisting in a drug-related investigation when police noticed a suspicious Dodge vehicle in the area of the borough police station without the headlights on and driving at a high rate of speed.

While investigating and making contact with the driver of the vehicle on the 900 block of Center Street, the operator, later identified as Pauloski, put the car in reverse and then drove forward and attempted to strike Marzen, and in the process, struck a parked Toyota Corolla. Marzen ran back to his patrol car and attempted to stop the vehicle using his lights and sirens.

Pauloski fled at an extremely high rate of speed, and Marzen noticed he failed to stop at six stop signs on Center Street. At that point, Marzen lost contact with the vehicle.

Pauloski fled into Penn Forest Township, where he abandoned his vehicle. He then broke into a building on the property of White Water Rafters and took clothing from the facility. Through the course of the investigation, police found out that the registration on the vehicle Pauloski was operating had been stolen. He was eventually taken into custody and charged.

Serfass also ordered Pauloski to supply a DNA sample, pay court costs of about $1,000, and make total restitution to victims of $1,157.78.
