Carbon County Court - ARD

Six defendants in pending criminal cases were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program by President Judge Roger N. Nanovic II this week.

If a person successfully completes all conditions of the program their record will be wiped clean. However, if they fail to complete the program, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.

Brittany Nicole Smith

, 29, of Palmerton, was placed for six months on a charge of retail theft. She was arrested on Jan. 16 by Mahoning Township police at the Walmart store.

She was assessed $450 for the cost of the program and ordered to make restitution of $97.73, her share of the total due.

Michael Lee Anthony Jr.,

29, of Palmerton, was placed for six months. He was involved with the same retail theft as Smith.

He was assessed $450 and ordered to make restitution of $97.73, his share of the total due.

Stephen Wargo Jr.,

49, of Summit Hill, was placed for a year on a charge of possession of a controlled substance. He was arrested on Dec. 4, 2019, along East White Street by Summit Hill police. According to the police report it was part of a county drug task force operation.

He was assessed $450 and ordered to get both drug and alcohol and mental health evaluations and follow any recommendations for treatment.

Susan Turturro,

52, of Nesquehoning, was placed for a year on a charge of possession of marijuana. She was arrested on April 18 by Nesquehoniing police near the solar park off Haul Road.

She was assessed $450 and ordered to get a drug and alcohol evaluation.

Shaira Marie Velazquez-Rosario

, 19, of Allentown, was placed for a year on a charge of possession of marijuana. She was arrested on Feb. 24 by Nesquehoning police along Market Street following a traffic stop.

She was assessed $450 and ordered to get a drug and alcohol evaluation.

Jason M. Griffation

, 35, of Nazareth, was placed for a year on a felony count of fleeing or attempting to elude police. He was arrested n May 25, along Lentz Trail by Jim Thorpe police. He was operating a motorcycle in the area of the Mauch Chunk Lake Park and led police on a short chase.

He was assessed $450 and ordered to get a mental health evaluation.

Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while in the program.
