Credit defaults

The following actions were filed by credit card companies, or their collection agencies, for alleged defaults on credit card/loan accounts.

Portfolio Recovery Associates, Mechanicsburg, filed an action against Rebecca L. Green, 96 Lehigh Ave., Palmerton, seeking $2,005.09.

American Express National Bank, Bensalem, filed an action against Susan Truskey, 37 Fern St., Lake Harmony, seeking $2,403.96.

Midland Funding, Essington, filed an action against Elizabeth Hutchinson, 231 White St., Lehighton, seeking $14,146.87.

Cavalry SPV I, Valhalla, New York, filed an action against Kathy Strouse, 34 Center St., Lansford, seeking $2,137.67.

Capital One Bank, Glen Allen, Virginia, filed an action against Anna L. Racko, 333 E. Abbott St., Lansford, seeking $4,477.01.

Mortgage foreclosures

The following actions were filed as mortgage foreclosures for alleged defaults on loans.

Lakeview Loan Servicing, c/o 4425 Ponce DeLeon Blvd., Coral Gables, Florida, filed an action against Natasha Garger, 650 Lafayette Ave., Palmerton, over property at that address. Sought is $128,060.14 and continuing interest.

Pennymac Loan Services, c/o 3043 Towngate Road, Westlake Village, California, filed an action against Kazimierz Pietkiel, 36 Penn Forest Drive, Albrightsville, over property at that address. Sought is $87,884.71 and continuing interest.

Crash suit

Matthew Stauffer, 57 Penn Spring Drive, Jim Thorpe, filed a civil complaint against Paul Karelus, 47 Pasadena Place, Buffalo, New York, over an automobile crash.

The suit states on June 7, 2018, the plaintiff was operating a vehicle on the southbound off ramp of the turnpike at the Mahoning Valley Interchange when his vehicle was struck by one operated by the defendant. The crash allegedly caused severe and permanent bodily injuries to the plaintiff, which are detailed in the suit.

Negligence is alleged against the defendant and sought are damages not in excess of $50,000.

Work not done

David Wheeler, of 4064 Dillingersville Road, Zionsville, Lehigh County, filed a civil action against Matthew Moyer, 131 Fairview St., Lehighton, alleging the defendant did not complete home improvement work he was hired to do on a property owned by the plaintiff.

The suit states on Aug. 15, 2019, Wheeler entered into a home improvement contract with Moyer to perform certain hardscaping work on a property 133 Bear Creek Lake Drive, in Jim Thorpe, Penn Forest Township. The price was $61,400.

The contract called for a down payment of $15,183 for labor and $14,500 for materials, totaling $19,683.

The scope of the work, per contract, included a patio installation, fire pit installation, seat wall installation, walkway installation, walkway border and accent boulder installation.

The suit states the plaintiff made two separate deposits toward the project of $29,635 and $16,500, totaling $46,135.

The suit alleges “despite payment, Moyer has failed to timely and full complete the project in accordance with the contract.”

The suit alleges, among other things, breach of contract, unjust enrichment and other allegations.

Sought is damages of $36,925 together with “an award of costs of suit and other relief the court deems just and reasonable.
