West Penn zoning ordinance to be presented to public soon

A draft of the section of West Penn Township’s new zoning ordinance could be presented to the public on Feb. 25.

Board solicitor Paul J. Datte told board of supervisors Chairman Tony Prudenti at Monday morning’s meeting they are working on the draft of the existing zoning ordinance.

Datte said it will be broken down into two sections: hydrogeological information, such as the impact on surrounding wells; and also off-site use, which will pertain to the use of water off-site.

The ordinance will first be reviewed by the supervisors, and a public hearing is expected to be held sometime in March.

Datte said comments and revisions will then be sent to attorney Jordan Yeager’s firm for review, and the comments incorporated in the zoning draft.

An additional public hearing will follow on the entire ordinance.

The report could be released to the public at the planning commission’s Feb. 25 meeting, and the board of supervisors would then review those provisions at its March 2 meeting.

Earlier this month, Jay Land, president and owner of Ringgold Acquisition Group II, told supervisors that in 2001 the township granted a permit. From 2001 until 2016, three additional permits were approved by the township.

On Dec. 5, 2015, adopted a water extraction ordinance after six months of public meetings.

In 2017 the township adopted a well registration ordinance after several months of public hearings. Since that time the township has spent two years in committee meetings and an estimated $30,000 to $50,000 trying to advance a more comprehensive water ordinance.

Land then addressed the Delaware River Basin Commission application submitted by Tower Springs in July to the DRBC.

He said there are only two production wells on the property as shown in the application to the township in 2014 and the Federal Register. There is no increase in capacity associated with the application.

Land said that his calculation is 75 trucks maximum and there is currently no limit on what can be produced on the property daily.
