Carbon County court — guilty pleas

A Carbon County woman entered guilty pleas on Tuesday morning in the county court in four pending criminal cases.

She was one of eight defendants in pending cases to enter a guilty plea before President Judge Roger N. Nanovic II.

Drugs, theft

Carly Jo Fairchild

, 25, of Summit Hill, pleaded to two counts of possession of a controlled substance and one count each of possession of drug paraphernalia and retail theft. One of the possession counts was to contraband in prison, a felony.

She was arrested on the contraband charge on March 20. Nesquehoning police were called to the county prison where a person being processed into the prison was found with drugs. Fairchild was brought to the prison by Summit Hill police.

The other possession count occurred on March 20 along North Oak Street filed by Summit Hill police. Heroin was found on her person. The possession of paraphernalia count occurred on Sept. 4, 2018, filed by Lansford police for an incident at Bertsch and Pardee streets. The retail theft occurred at the Family Dollar Store in Lansford on Nov. 2, 2018.

Nanovic deferred sentencing and ordered the adult probation office to prepare a presentence investigation report. Fairchild is currently an inmate in the county prison.

Other pleas

Dana Fratesi

, 35, of Lehighton, pleaded to one count of simple assault for an incident on Sept. 20, 2018, filed by Franklin Township police. Police were called to the Lehighton Middle School by administrators. They told police a juvenile student told them his mother had struck him in the head twice during a dispute at home. The boy suffered a concussion, the police report noted. A charge of aggravated assault was dropped in a plea deal with the DA.

Fratesi told Nanovic she has not seen her son since the incident and that there is a protection from abuse order in place for three years prohibiting her contact with the boy.

Nanovic said the PFA order and the fact she has not seen her son in over a year was sufficient punishment and that no jail time would be imposed. He placed her on probation for six months and ordered her to attend parenting classes.

Cody Benjamin Formisano

, 24, of Jim Thorpe, pleaded to one count each of driving under the influence and possession of drug paraphernalia in two separate incidents. He was arrested on the possession count on Aug. 26, 2015, by state police at Lehighton following a traffic stop along Route 248 at State Road in Franklin Township. The DUI occurred on Sept. 9, 2015, along Main Road in Franklin Township filed by state police. A test revealed the presence of a controlled substance.

Sentencing was deferred because Formisano must get a drug and alcohol evaluation on the DUI charge.

Jacob J. Canzoneri,

37, of Nesquehoning, pleaded to one count each to possession of drug paraphernalia and persistent disorderly conduct in two pending cases.

He was arrested on the drug count on July 26 by Nesquehoning police along East Garibaldi Avenue. He was arrested on the conduct charge on July 8 along East Diaz Street by Nesquehoning police.

Canzoneri told the court he had entered a rehabilitation program and is continuing counseling.

Nanovic placed him on probation for six months on each count, with the terms running concurrently, and ordered he continue counseling until successfully discharged and zero tolerance imposed on drug or alcohol use.

Kyle Alan Rappold,

20, of Palmerton, pleaded to one count of harassment, as a summary offense, with a charge of simple assault dropped in a plea bargain with the DA.

He was arrested on Oct. 12, 2018, by state police at Lehighton following a domestic incident.

He was fined $150 and costs.

Carter Kurak Wolfe,

28, of Jim Thorpe, pleaded to one count of unlawful restraint for an incident on Oct. 2 filed by Jim Thorpe police. A charge of terroristic threats was dropped in a plea deal with the DA.

Police responded to a residence along Main Street. On scene a female told the officers she had been assaulted by Wolfe, who was then her boyfriend, and that he had threatened her with a knife.

Wolfe, who is an inmate in the county prison on the charges, told the court, “I’m extremely sorry, I was going through a tough time in my life.” He said his grandmother had recently died. He also said he was receiving treatment for a mental health issue and was not taking his medication at the time of the incident.

Nanovic sentenced him to serve one to one day less 24 months in prison with credit for 41 days already served, and paroled him. He was also ordered to get both drug and alcohol and mental health evaluations, attend and successfully complete an anger management course and have no contact with the victim.

Scott Lee Fichter

, 52, of Albrightsville, pleaded to one count of simple assault. He was arrested by state police at Fern Ridge on Oct. 6 along Long Broad Way in Penn Forest Township, following a domestic incident. A charge of strangulation, a felony, was dropped in a plea deal with the DA.

He was placed on probation for a year and ordered to attend and successfully complete an anger management course.

Carl Propson,

49, of Allentown, pleaded to one count each of driving under suspension and possession of drug paraphernalia. He was arrested following a traffic stop by Summit Hill police on Jan. 1 along Amidon Street. It was noted the suspension charge is Propson’s eighth overall.

On the suspension charge Nanovic sentenced him to the mandatory minimum of 30 days to six months in jail and a fine of $1,000. On the drug charge he was placed on probation for six months, consecutive to the suspension count. He was also ordered to get a drug and alcohol evaluation.

He will begin the jail term at 7 p.m. on Nov. 17 and serve it on 48 hour consecutive periods.

Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
