Two New York men face charges for possession of marijuana

Two New York men face charges after they were found to be in possession of marijuana during a traffic stop in Kidder Township.

According to the affidavit of probable cause filed by trooper George Tessitore of the Pennsylvania State Police, Troop N, Fern Ridge station:

At 9:35 a.m. May 4, Tessitore was traveling westbound on I-80 in Kidder Township when he observed a gray 2018 Honda Accord to be following too closely to the vehicle in front of it.

Tessitore initiated a traffic stop, and approached the passenger’s side of the vehicle, at which time the operator provided him with a license identifying him as Krystian Jevon Lewis, 22, of Saint Albans, New York.

Tessitore observed numerous air fresheners inside the vehicle and he had Lewis exit. He saw Lewis was overly nervous with visibly shaking hands and a pulsating carotid artery.

Tessitore also spoke with the passenger, Dimitry Hayes, 18, of the Bronx, New York, and received conflicting stories from what Lewis had told him.

Tessitore then requested consent to search the vehicle, which was denied by Lewis.

Cpl. Anthony Doblovasky and narcotics detection K-9 Micho arrived on scene. After an exterior search, Doblovasky advised Tessitore that K-9 Micho alerted to the odor of narcotics.

A probable cause-based search on the vehicle yielded two baggies of marijuana, drug paraphernalia, a credit card publishing machine, several fictitious identifications and credit cards.

At this time, the driver attempted to throw a black credit card to the shoulder of the roadway.

Both men were taken into custody and transported to the Fern Ridge barracks.

The driver was processed and found to have provided false identification. He then identified himself as Carlos Gonzalez, 22, of Saint Albans, New York.

Gonzalez faces charges of access device fraud; the controlled substance, drug device and cosmetic act: prohibited acts; possessing instruments of crime; tampering with or fabricating physical evidence; access device fraud; false identification to law enforcement authority; driving while operating privilege is suspended or revoked; violations concerning licenses; and following too closely.

Hayes faces charges of access device fraud; the controlled substance, drug device and cosmetic act: prohibited acts; and possessing instruments of crime.

Both men are currently incarcerated in the Carbon County Correctional Facility in lieu of $100,000 bail each, and are scheduled to have a preliminary hearing May 15 before District Judge Joseph D. Homanko of Weatherly.
