Carbon County court — DUI

Two defendants, who previously pleaded guilty, were sentenced to prison terms on Monday in Carbon County court for driving under the influence with children in their vehicles.

Lehighton incident

Heather Lynn Cebrosky

, 30, of Palmerton, was sentenced by Judge Steven R. Serfass to serve three to 23 months in prison on a charge of endangering the welfare of children, and 90 days to 60 months in jail on a driving under the influence count. The jail terms run concurrently.

Cebrosky was arrested on Oct. 27, 2017, by Lehighton police along Second Street. In the vehicle with her was her then 3-year-old daughter.

Since her arrest she told Serfass she spent 24 days in an inpatient rehabilitation program and is continuing outpatient counseling. She told the court, “I’m sorry about that night.” She said she was trying to get her life back.

The father of the child asked the court to impose a lengthy sentence, claiming Cebrosky “waited 11 months to get help.”

Serfass said, “It’s fortunate that nothing more tragic happened.” Serfass denied her request to be placed in the Intermediate Punishment Program, house arrest. The adult probation office recommended she not be placed in the program due to the nature of the charges.

Serfass ordered her, on the DUI count, to pay a fine of $1,500 and her license suspended for a year. She was also ordered to render a total of 200 hours of community service over the 23 month total sentence, pay court costs of about $1,000 and a $50 per month supervision fee while on parole. She was given credit for the 24 days spent in the inpatient program.

She will begin serving the prison term at 8 a.m. on May 2 and serve it on consecutive two-day periods.

Packer incident

Crishner Craig Samuel

, 32, of Weatherly, was sentenced to serve three to 23 months in prison on a endangering count and 48 hours to 60 months on a DUI count, with the terms running concurrently.

He was arrested on Dec. 26, 2016, by state police at Hazleton along Route 93 in Packer Township. A test revealed a 0.24 BAC. He was arrested after he was involved in a crash. Troopers found his then 4-year-old son in the vehicle.

“How could you get into a vehicle under the influence with your child with you and drive?” Serfass asked him.

Samuel only shook his head in response.

On the DUI count Serfass ordered Samuel to pay a fine of $1,500, his license suspended for 18 months, render a total of 200 hours of community service, make restitution totaling $3,664.88 for damages in the crash, zero tolerance for drug or alcohol use, pay court costs of about $1,000 and pay a $50 per month supervision fee while on parole.

He will begin the jail term at 2 p.m. on May 10 and serve it on consecutive two-day weekends.
