Borough files suit

Palmerton Borough, 443 Delaware Ave., has filed a civil action against Larry E. Rodgers, 957 Edgemont Ave., Palmerton, contending the defendant is in violation of an ordinance the borough has adopted as part of the International property Maintenance Code.

The complaint states Rodgers owns a property at the above address where nine vehicles and parts or portions of vehicles are stored in violation of the ordinance.

It alleged the borough’s Code Compliance Officer, Clark Ritter, inspected the property and issued 24 nontraffic citations against Rodgers, who was found guilty of the citations by Magisterial District Judge William Kissner.

The borough is asking the court to award it a fine of $600 per day for each day the violations continue, plus costs and attorney’s fees, and to authorize the borough or its agents authority to enter the property and remove the vehicles and to enter a lien against Rodgers for costs and expenses associated with the cleanup.

Quiet title action

David Keller, 1933 Route 903, Jim Thorpe, has filed a complaint in quiet title against Wells Fargo Bank N.A. and Wachovia Bank N.A. Charlotte, North Carolina, over a property at 43 Basswood Court, Indian Mountain Lakes, Albrightsville.

The complaint states Keller became the owner of the property through a sale conducted by the Carbon County Tax Claim Bureau on Sept. 21, 2018, and that the defendants are holders of a mortgage on the property that is open of record.

Keller asks the courts to grant him clear title to the property.

Subrogation complaint

Progressive Advanced Insurance, Mayfield, Ohio, has filed a complaint against Christine Trine, 328 E. Abbott St., Lansford, saying it became subrogated to the claim of its insured against the defendant.

The suit states on Dec. 31, 2016, the defendant was operating a vehicle negligently, recklessly and/or carelessly when it collided with a vehicle operated by Charles J. Hayes, 164 Upper Green Hill Road, Kunkletown, on Blakeslee Boulevard in Lehighton. The plaintiff states it paid $2,185.76 for the vehicle to be repaired of damages it sustained, plus rental costs during the time the vehicle was in repair.

Progressive asks the court to enter judgment in its favor in that amount against Trine.

Complaint in ejectment

The Secretary of Veterans Affairs, Nashville, Tennessee, has filed a complaint in ejectment against Erin Kelly and Arron Leiberman, 60 David Circle, Lehighton, over a property at that address.

The complaint states the PA Housing and Finance Agency was the successful bidder on the property at a sheriff’s sale dated Aug. 10, 2018, and became owner of the property formerly owned by Kelly and currently occupied by Leiberman by virtue of a deed recorded Oct. 10, 2018.

The plaintiff states the defendants are occupying the premises without right and asks the court to order a judgment of possession in its favor.

Judgments recorded

The Estate of Myrtle Louise Renner, Marie Bieling, administrator, 450 Oak St., Palmerton, has placed on record two judgments entered in its favor against Craig S. Rex and Renae Gray, 285-3 Lower Nis Hollow Drive, Lehighton, over rental arrearages.

One judgment was ordered on Dec. 14, 2017, by Magisterial District Judge William Kissner in the amount of $5,046.11. The other was ordered by the same magistrate on May 25, 2017, in the amount of $2,410.19.

Appeals MDJ decision

Louise A. Keiper, 325 North St., Floor 1, Jim Thorpe, has filed an appeal of a decision rendered by Magisterial District Judge Eric Schrantz on Dec. 20, 2018, in favor of Mason Realty Company and Todd Mason, 101 S. Tenth St., Jim Thorpe.

The matter is a landlord/tenant dispute.
