Man who stole bird cage given prison term

A man who admitted stealing a bird cage from a yard was sentenced to a prison term and house arrest on Tuesday.

Lawrence Alfred Stewart, 49, of Summit Hill, who previously pleaded to receiving stolen property, was sentenced by President Judge Roger N. Nanovic to serve 30 days in jail followed by one year in the county’s Intermediate Punishment Program — house arrest — with the first 60 days on electronic monitoring.

He was arrested for stealing a large bird cage from a property on West Catawissa Street by Nesquehoning police on Feb. 21. The cage is valued at $300.

At the guilty plea proceeding Nanovic told Stewart, based on his prior record and the charge, a misdemeanor 1, he was facing a prison term with the standard range between three and 14 months. Stewart then requested consideration for the IPP, which was granted by the court.

Stewart told the court, “Sorry for what I did.”

Stewart said he was under the influence of alcohol at the time.

When questioned by Nanovic how much he drank, he told the court, “about 12 cans.”

He said he regularly drank about 12 cans of beer a day but now was trying to cut back, stating he was trying to keep at two cans a day. He also said when he took the bird cage he did it because of “a dare by a friend.”

Nanovic also ordered Stewart to get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance for drug and alcohol use, pay court costs of about $1,000 and pay a $50 per month supervision fee.

He will begin the jail term at 7 p.m. on Jan. 5 and serve it on consecutive two-day weekends.
