Carbon County court — Parole/probation revocation

Several parole/probation revocations hearings were recently held by Carbon County judges on petitions filed by the adult probation office against defendants who violated the terms of their release.

Samantha Weaver

, 27, of Jim Thorpe, had her probation revoked in three cases on petition of probation officer Joseph Bettine for violating conditions on charges of attempting to sell, transfer or deliver a firearm; false reports; and endangering the welfare of children. The cited violation was being arrested by Kidder Township on drug counts.

President Judge Roger N. Nanovic II resentenced her to serve three to one day less 24 months in the county prison on each count, with the terms running concurrently. She will serve the time on consecutive weekends of Fridays to Tuesdays. The sentence was effective Nov. 10 at 9 a.m.

Lawrence Mustacchio

, 58, of Lehighton, had his parole revoked on a charge of agricultural trespass on petition of probation officer Clifford Eckhart for violating conditions by failing to report to the probation office as directed, absconding from his approved residence and failing to perform 50 hours of community service.

Judge Joseph J. Matika resentenced him to serve 90 days back-time effective Nov. 22, with credit for 33 days already served.

Joel Puppo

, 54, of Albrightsville, had his parole revoked on a charge of driving under the influence on petition of Bettine for violating conditions by not making a concerted effort to pay court costs and failing to complete 25 hours of community service.

Matika resentenced him to serve three months back-time effective March 1, 2018. If he completes the community service by that date and pays $100 a month on his costs, the order will be vacated.

Andrew Hitchko III

, 29, of Hellertown, had his parole revoked on a charge of DUI on petition of Bettine for violating conditions by not making a concerted effort to pay court costs and failing to complete highway safety classes.

Nanovic resentenced him to serve three months back-time effective March 1, 2018. However, if he completes the safety classes and pays $300 on court costs along with his regular monthly payments by that date the order will be vacated.

Nicholas Cantelmi

, 28, of Jim Thorpe, had his parole revoked on a charge of DUI on petition of Bettine for violating conditions by being arrested by Kidder Township police on new criminal charges.

Judge Steven R. Serfass resentenced him to serve 181 days “street time” in the county prison. The effective date was May 12, when he was first incarcerated on the violation.

ARD revoked

The following defendants had their placement in the Accelerated Rehabilitation Disposition probation program revoked for violating conditions.

Kaitlin Helmer

, 22, of Beaver Meadows had her placement revoked on a charge of possession of a controlled substance on petition of Bettine for violating condition by failing to pay court costs.

Marina Vasilyeva

, 60, of Jim Thorpe, had her placement on charges of forgery, tampering with records, identity theft and theft on petition of Bettine for violating conditions by failing to pay court costs and failing to complete 100 hours of community service.

Hasan Spencer

, 25, of Allentown, had his placement on a charge of false identification to law enforcement on petition of Bettine by violating conditions by failing to pay court costs and failing to complete 25 hours of community service.

Robert Freeman

, 23, of Jim Thorpe, had his placement on a charge of DUI, possession of a small amount of marijuana and possession of drug paraphernalia revoked on petition of Bettine for violating conditions by being arrested on new criminal charges by state police at Lehighton, failing to pay court costs and failing to complete a safe driving course.

All four had their cases returned to the pretrial list.
