Schuylkill County Court

A Northampton man charged with driving under the influence of a controlled substance, heroin, with his young children in his car will serve 36 months on probation.

Schuylkill County Judge Charles M. Miller placed Timothy I. Serrano,

39, of Northampton, on probation and ordered him to keep his job and to pay a total of $2,215 in court costs and fees.

Serrano was charged by Kline Township police with three counts of endangering the welfare of children; driving under the influence of a controlled substance; three counts of recklessly endangering another person; failing to restrain a child under age 2 and failing to restrain a child under age 4 in car seats; and failing to use child booster seats on Aug. 12, 2016.

The DUI charge, and the charges of failing to restrain a child under age 2 and failing to restrain a child under age 4 in car seats, were dropped.

In other actions, Judge Cyrus Palmer Dolbin sentenced a Pittsburgh man to serve 18 months on probation for conspiracy to commit retail theft.

Kevin J. Tansley,

30, was charged by Rush Township police with the crime on March 31, 2016.

Dolbin imposed the sentence in addition to ordering Tansley to pay $69.54 restitution to Walmart, and to pay a total of $1,510 in court costs and fees.

Probation revocations

Sarah A. Bensinger,

26, of Tamaqua, was charged by borough police with possession of drug paraphernalia on Feb. 7, 2015.

After she violated the terms of her probation, Schuylkill County Judge James P. Goodman revoked her probation, imposed on Nov. 30, 2016, and sentenced her to three to six months in jail, with credit for 73 days she already served.

Bensinger was also ordered to pay $2,441 in court costs and fees; obtain a drug and alcohol assessment, and to attend short-term inpatient treatment, with early parole to an approved facility.

Judge Cyrus Palmer Dolbin revoked the probation of a Coaldale man and sentenced him to 27 days to 12 months in jail, with immediate parole.

David P. Riegel Jr.,

23, was charged by Branch Township police with theft on May 8, 2013, and Pottsville police charged him theft on April 15, 2015.

Dolbin sentenced him to 12 months on probation after Riegel pleaded guilty to the charges on March 16, 2016.

But probation was revoked Riegel violated the terms.

Bench warrants dissolved

Max E. Gasker,

40, of Nesquehoning, was charged by West Penn Township police with defiant trespass, criminal trespass, and burglary on May 15, 2015.

Judge James P. Goodman dissolved the bench warrant against Gasker, and set bail at $5,000 percentage as Gasker awaits trial.

Rita Melusky,

47, of Pottsville, was charged by Rush Township police with simple assault and harassment on March 21, 2016.

Goodman dissolved her bench warrant, and set bail at $10,000 unsecured.

He ordered Melusky to notify the court if she wants to move from her current address.
