Man sentenced for indecent contact with girl

A Lehighton man was given a county prison term on Monday after previously admitting having indecent contact with a teenage girl.

Donald H. Ellis Jr., 50, was sentenced by President Judge Roger N. Nanovic II to serve one day less 12 to 1 day less 24 months prison followed by one year of probation on a charge of corruption of a minor and the same term, running concurrently, on a charge of indecent assault.Ellis was charged by Lehighton police for an incident on July 10, 2016, at a home along Mahoning Street. The then 13-year-old girl and her mother reported the incident to police.She said she was taken by Ellis to a home in the borough where he made inappropriate contact with her in a sexual manner. The girl also said he put a "hickey" on her buttock. He also exposed himself to the girl.Attorney Paul J. Levy told the court his client has undergone counseling since the incident and continues to do so. He also said Ellis recognized what he did was wrong and cooperated with police in their investigation.Ellis told Nanovic that he was sorry for what occurred. "I have nightmares about this. I know I hurt her."He continued, "I don't understand how I did this. I'm sorry for all I caused her and all the things I've done. I hope some day she will forgive me."Nanovic said he was concerned about information contained in a presentence investigation report prepared by the adult probation office in which Ellis states the victim "came on to him.""It seems you didn't do very much to resist this," Nanovic said. He added, "You were the adult here and should have known better."Nanovic also said the letters of support he received from family of friends of Ellis indicate he is basically a good person who did wrong.At the prior plea proceeding the victim addressed the court.The girl told the court the incident changed her life, that she is fearful of men and has nightmares about what happened. It has affected her school work and forced her into receiving counseling. She said she depends on her mother to get through the depression she is going through.Ellis underwent an evaluation by the state sexual offenders assessment board and was determined not to be a sexual violent predator. He must register as a sexual offender for the next 25 years. Had the board determined he was a sexual violent predator the registration period would have been for life.Nanovic also ordered Ellis to submit to a sexual offenders evaluation, pay $1,090 to the victim's assistance program, have no contact with the victim or her mother, supply a DNA sample, have no unsupervised contact with anyone under 18, pay court costs of about $1,000 and when released on parole pay a $50 per month supervision fee.He will begin the jail term at 5 p.m. Friday.
