Schuylkill County court - ARD

Schuylkill County judges have placed eight people charged by local police into the Accelerated Rehabilitative Disposition program. Placement in the program, for nonviolent first-time offenders, is not an admission of guilt. It offers defendants an opportunity to clear their records if they successfully complete the program.

The defendants also have to pay court costs and fees.Andrew Lewis, 46, of Tamaqua: Charged by Tamaqua police with driving under the influence, first offense; driving under the influence, highest rate of blood alcohol (blood alcohol content of more than 0.16 percent), first offense; driving under the influence of a schedule 1 controlled substance, first offense; driving under the influence of a controlled substance, combination alcohol/drugs, first offense; speeding; and driving under the influence of a schedule 2 or 3 controlled substance, first offense on June 17, 2016.President Judge William E. Baldwin placed him in the ARD program for 12 months and ordered him to pay $500 to offset the cost of the program.Lewis must surrender his license for 60 days, enroll in Alcohol Highway Safety School, obtain outpatient substance abuse counseling, and submit to random urine screens.Brett D. Horvath, 48, of Nesquehoning: Charged by West Penn Township police with driving under the influence, first offense; driving under the influence, highest rate of blood alcohol (blood alcohol content of more than 0.16 percent), first offense; and careless driving on Sept. 1, 2016.Baldwin placed him the ARD program for 12 months, and ordered him to pay $500 to offset the cost of the program.Horvath must surrender his license for 60 days, enroll in Alcohol Highway Safety School, obtain outpatient substance abuse counseling, and perform 10 hours of community service.Sean Bonilla, 29, of Lansford: Charged by Tamaqua police with driving under the influence, first offense; driving under the influence of a schedule 1 controlled substance-first offense; driving under the influence of a controlled substance-combination alcohol/drugs, first offense; turning movements and required signals; and disregarding a traffic lane on June 26, 2016.Baldwin placed him the ARD program for 12 months, and ordered him to pay $500 to offset the cost of the program.Bonilla must surrender his license for 60 days, enroll in Alcohol Highway Safety School, obtain outpatient substance abuse counseling, and perform 10 hours of community service.Ashley E. Bevans, 29, of Beaver Meadows: Charged by McAdoo police with use/possession of drug paraphernalia, and public drunkenness and similar misconduct on Oct. 20, 2016.Baldwin placed her in the ARD program for 12 months, and ordered her to pay $350 to offset the cost of the program.Bevans was also ordered to perform 10 hours of community service.Alexia M. Vajda, 21, of Hazle Township: Charged by Kline Township police with conspiracy to commit burglary; theft by unlawful taking; receiving stolen property; conspiracy to commit criminal trespass; conspiracy to commit theft by unlawful taking; and conspiracy to receive stolen property on Nov. 21, 2016.Baldwin placed her the ARD program for 12 months, and ordered her to pay $350 to offset the cost of the program.He also ordered Vajda to pay $210 restitution to Phil DeLauretis and to perform 10 hours of community service.William E. Smith III, 30, of Allentown: Charged by McAdoo police with use/possession of drug paraphernalia on Nov. 18, 2016.Baldwin placed him the ARD program for 12 months, and ordered him to pay $350 to offset the cost of the program.Smith was also ordered to perform 10 hours of community service.Thomas J. Ohazzo, 20, of McAdoo: Charged by McAdoo police with use/possession of drug paraphernalia; possession of marijuana; and operating a vehicle without a valid inspection sticker or rear lights on Dec. 4, 2016.Baldwin placed him the ARD program for 12 months, and ordered him to pay $350 to offset the cost of the program.Ohazzo was also ordered to perform 10 hours of community service.Richard G. Maxwell, 51, of Lackawanna, New York: Charged by McAdoo police with driving under the influence, first offense; driving under the influence of a schedule 1 controlled substance-first offense; use/possession of drug paraphernalia; possession of marijuana; possession of a small amount of marijuana for personal use; and operating a vehicle without headlights on Aug. 26, 2016.Baldwin placed him the ARD program for 12 months, and ordered him to pay $500 to offset the cost of the program.Maxwell must surrender his license for 60 days, enroll in Alcohol Highway Safety School, obtain outpatient substance abuse counseling, and perform 10 hours of community service.
