Carbon County court - Parole/probation revocation
Parole/probation revocation hearings were held by Carbon County Judge Joseph J. Matika recently on petitions filed by the adult probation office against defendants who have violated the terms of their release.
Tara Good, 31, of Albrightsville, had her parole revoked on charges of possession of drug paraphernalia on petition of probation officer Joseph Bettine for violating conditions by failing to report for her scheduled urine screen which violated the zero-tolerance condition.Matika resentenced her to serve 90 days "street time" in the county prison effective March 17.Desiree Kaminitsky, 29, of Jim Thorpe, had her probation revoked on a charge of driving under the influence on petition of Bettine for violating conditions by failing to report to the probation office as directed, not residing at her approved residence and her whereabouts unknown, failing to complete safe driving school classes and failing to complete 25 hours of community service.Matika resentenced her to serve 50 to 100 days in the county prison with credit for 100 days already served.Negine Wise, 22, of Albrightsville, had her probation revoked on a charge of possession of drug paraphernalia on petition of Bettine for violating conditions by failing to complete 25 hours of community service.Matika resentenced her to serve one to three months in the county prison effective Aug. 1. However, if she completes the community service by that date the order will be vacated.Heather Getley, 31, of Albrightsville, had her probation revoked on a charge of retail theft on petition of Bettine for violating conditions by failing to complete 50 hours of community service.Matika resentenced her to serve one to three months in the county prison effective Aug. 1. However, if she completes the community service work by then the order will be vacated.ARD revokedThe following defendants were revoked from the Accelerated Rehabilitation Disposition probation program.Brandon Bennyhoff, 26, of Summit Hill, was revoked on a charge of DUI on petition of probation officer Clifford Eckhart for violating conditions by failing to pay court costs, failing to complete highway safety program, failing to complete drug and alcohol treatment and failing to perform 50 hours of community service.Matika ordered the case placed on the May 9 pretrial list.James Eismann, 56, of Richlandtown, Bucks County, was revoked on a charge of DUI on petition of Bettine for violating conditions by not paying court costs and not obtaining a drug and alcohol assessment and following all recommendations.Matika ordered the revocation effective Aug. 1. However, if Eismann pays his court costs in full and completes the drug and alcohol assessment by that date the order will be vacated.Amber Sypeck, 28, of Weatherly, was revoked on a charge of DUI on petition of Bettine for violating conditions by failing to pay court costs, failing to complete drug and alcohol treatment and failing to complete 50 hours of community service.Matika ordered the revocation effective Aug. 1. However, if Sypeck pays her court costs in full, completes the drug and alcohol treatment and the 50 hours of community service by that date, the order will be vacated.Bail hearingsMatika conducted bail hearings for the following defendants.Ariel Stevens, 20, of Lansford, was found in violation of her bail terms by repeatedly testing positive for a controlled substance and failing to engage in drug and alcohol treatment.Bail was reset at $10,000 percentage (10 percent).Joseph Becker, 34, of Summit Hill, was found in violation of his bail terms by absconding from his approved residence and failing to report to the probation office as directed.Bail was reset at $7,500 percentage (10 percent).
