Carbon man enters guilty pleas in seven cases, gets prison term

A Carbon County man entered guilty pleas on Friday in seven pending cases and was immediately sentenced to a county prison term. He also faces a big restitution bill.

Shane G. Smith, 42, of Palmerton, entered the pleas before President Judge Roger N. Nanovic II. He pleaded to four counts of possession of drug paraphernalia, and one count each of driving under the influence, criminal trespass, forgery and possession of a controlled substance. He was charged in incidents that occurred in Palmerton.Nanovic sentenced to serve a total of four to one day less 24 months in prison followed by two years of probation. He must also make restitution of $13,228.The criminal trespass charge stems from an incident on Nov. 1, 2015, in which he entered a home in Palmerton and took checks and forged names on the checks and cashed them. The large restitution bill is for this incident. The forgery incident occurred on Jan. 29 and involved checks taken in the November incident.The drug counts stem from incidents on April 9, 11 20, and 29 in Palmerton. The DUI occurred on March 16 along Alley H in Palmerton. A test revealed the presence of a controlled substance.Smith told Nanovic, "I have a problem with drugs. I plan to do something about it. I plan to seek help."He said he used $9,000 of the $13,228 to pay off a drug debt.Nanovic also ordered, in the DUI case, that he to pay a fine of $1,000, and has license was suspended for 18 months. He must also get a drug and alcohol evaluation, zero tolerance for drug and alcohol use, supply a DNA sample, pay court costs of about $1,000 and pay a $50 per month supervision fee while on parole or probation. He was given credit for 95 days on the DUI charge, in which a prison term of 72 hours to six months was imposed.He received no credit on the remaining counts and will serve the minimum of four months.
