Man gets prison for indecent assault

A Lansford man was sentenced to a county prison term on Tuesday afternoon on a charge of indecent assault but won't be spending any more time in jail because of the lengthy period he spent in custody on the charge already.

Patrick J. Kelly Jr., 30, was sentenced by Judge Joseph J. Matika to serve nine to one day less 24 months in prison on the misdemeanor two charge. However, he was given credit for 555 days already spent in custody on the charge.Because the charge falls under the provisions of Megan's Law he will have to register for the next 15 years as a sexual offender.In exchange for the plea, the district attorney's office agreed to drop three felony counts of aggravated indecent assault as well and misdemeanor one counts of indecent assault and indecent exposure.The case took a long time in reaching a conclusion as there were 29 continuances granted by the court in the course of the case most by defense counsels but not all, as some were also filed by the prosecution.Lansford police charged him on June 6, 2013, with having indecent contact with a then 5-year-old girl at a residence in the borough. Kelly was 27 at the time, police said.The inappropriate contact was reported to the Carbon County office of children and youth.Matika said the sentencing proceeding will be some closure for the family of the victim but "not the end" of it. He said it was unfortunate that the victim and her family had to wait three years for a conclusion of the case.Kelly, who declined to say anything at the proceeding, also faced criminal charges in Northumberland County.Matika ruled his sentence would run concurrent with any Kelly is serving in that county. Matika also ordered Kelly to render 25 hours of community service, attend parenting classes, make restitution to the Victim's Compensation Board for $400 for counseling sessions the victim received, submit to a sexual offenders evaluation, pay court costs of about $1,000, pay a $50 per month supervision fee and have no contact with the victim.Fails to registerRoy E. Stenger Jr., 37, of Palmerton, was placed on probation for a year for violating the conditions of Megan's Law as a convicted sexual offender.Stenger previously pleaded to one count of falsification to authorities.He was arrested by Mahoning Township police who received information from state police that Stenger listed a fake address related to registration as a sexual offender.He was also ordered to render 50 hours of community service, pay court costs of about $1,000 and a $50 per month supervision fee while on probation.
