MILFORD (AP) - Prosecutors and defense lawyers agree than a jury from outside the area should decide the fate of a survivalist charged with fatally ambushing a Pennsylvania state police trooper near a rural barracks.

The stipulation between prosecutors and lawyers for Eric Frein keeps the trial in Pike County, where Frein is charged with fatally shooting Cpl. Bryon K. Dickson II and wounding another trooper.

The deal was announced Friday at a pretrial hearing in Milford. It must be approved by a judge, who says he will likely do so.

Defense lawyers had asserted that Frein can't get a fair trial in Pike County, in the Poconos, due to heavy news coverage about the 2014 ambush.

Frein has pleaded not guilty. Authorities are seeking the death penalty.
