Carbon County Court - Parole and probation hearings

Carbon County judges recently conducted parole/probation revocation hearings on petitions filed by the adult probation office against defendants who violated the conditions of their release.

Jerome Murphy, 38, of Tamaqua, had his probation revoked on a charge of possession of drug paraphernalia on petition of probation officer Clifford Eckhart for violating conditions by failing to report an address change, being charged with a new criminal offense and testing positive for a controlled substance.President Judge Roger N. Nanovic II resentenced to time served (23 days) to six months in prison.Michael Merenda, 40, of McAdoo, had his probation revoked on a charge of possession of drug paraphernalia on petition of probation officer Joseph Bettine for violating conditions by not making a concerted effort to pay court costs and failing to complete 25 hours of community service.Judge Joseph J. Matika resentenced him to serve three to six months in the county prison effective Nov. 2 at 9 a.m. However, if he completes the community service and pays $575 on his costs, along with his regular monthly payments, the order will be vacated.Romero McLain, 29, of Nesquehoning, had his probation revoked on a charge of receiving stolen property on petition of Eckhart for violating conditions by being charged with a new criminal offense and in possession of a controlled substance.Judge Steven R. Serfass resentenced him to serve 6 to12 months in the county prison, with credit for 131 days already served.David Leone, 25, of Summit Hill, had his parole revoked on a charge of arson on petition of Eckhart for violating conditions by failing to report to the probation office as directed and failing to maintain a stable, approved residence.Serfass resentenced him to serve 66 days to 18 months in prison with credit for the 66 days already served.Troy Dubois, 34, of Palmerton, had his probation revoked on a charge of recklessly endangering another person on petition of probation officer Kimberly Cooper for violating conditions by being arrested on new criminal charges.Nanovic resentenced him to serve 2 to 4 months in the county prison with the order stating he must serve the entire 4 months.Leanna Altemose, 29, of Palmerton, had her probation revoked on a charge of possession of drug paraphernalia on petition of Cooper for violating conditions by testing positive for a controlled substance which violated the zero-tolerance condition.Nanovic resentenced her to another year probation consecutive to another probation period she is currently serving.Shaina Haas, 26, of Lehighton, had her parole revoked on a charges of theft, access device fraud and defiant trespass on petition of Cooper for violating conditions by testing positive for opiates which violated the zero-tolerance condition.Matika resentenced her to serve out her maximum term which runs consecutive to probation periods she is also serving. Her maximum runs to Dec. 3, 2016. She may apply for reparole after April 24, 2016, but only for placement in an inpatient rehabilitation facility.Matthew Frederick, 21, of Palmerton, had his probation revoked in two cases on charges of aggravated assault and possession of drug paraphernalia on petition of Cooper for violating conditions by testing positive for amphetamines and alcohol, which violated the zero-tolerance condition.Serfass resentenced him to serve 6 to 18 months in the county prison on the first case and 30 to 90 days on the drug charge with the terms running concurrently and effective as of May 18. The order also states the full 90 days must be served in the second case.Justin Hill, 24, of Lansford, had his parole revoked on a charge of possession of drug paraphernalia on petition of Eckhart for violating conditions by failing to report to the probation office as directed, failing to submit to scheduled drug screens, failing to make payments on court costs, failing to attend and complete drug and alcohol treatment, failing to perform 50 hours of community service, and violating the zero -tolerance condition.Matika resentenced him to serve 90 days in the county prison with credit for 35 days already served.Brian Scott McGee, 33, of Palmerton, had his probation revoked on a charge of possession with intent to deliver a controlled substance on petition of probation officer Derek George for violating conditions by testing positive for morphine, which violated the zero-tolerance condition, and failing to pay court costs.Nanovic resentenced him to serve 90 days to 12 months in the county prison effective July 14.Thomas Michael Schaub, 37, of Lehighton, had his parole revoked on a charge of criminal conspiracy-theft on petition of George for violating conditions by failing to report as directed and repeatedly testing positive for a controlled substance.Nanovic resentenced him to serve the balance of his maximum term which runs to Sept. 10.Sean Holland, 24, of Weatherly, had his parole revoked on charges of possession of a controlled substance and selling, furnishing alcohol to minors on petition of Bettine for violating condition by testing positive for cocaine, which violated the zero-tolerance condition.Matika resentenced him to serve the balance of his maximum which runs to Oct. 17.Laurie Maguschak, 51, of Beaver Meadows, had her parole revoked on a charge of receiving stolen property on petition of Bettine for violating conditions by testing positive for opiates, which violated the zero-tolerance condition.Matika resentenced her to serve 90 days "street time" in the county prison effective July 9.Justen Neff, 35, of Lehighton, had his parole revoked in three cases on two counts of theft, and one of possession of drug paraphernalia on petition of McGinley for violating conditions by failing to report for scheduled urine screens, not making an effort to pay court costs and failing to obtain a drug and alcohol evaluation.Nanovic resentenced him to serve 3 months back time effective June 18.Randy Edgar, 33, of Lehighton, had his parole revoked in four cases on two counts of criminal conspiracy-theft, and one count each of criminal trespass and receiving stolen property on petition of George for violating conditions by testing positive for opiates which violated the zero tolerance condition.Matika resentenced him to serve 90 days in the county prison effective July 6.Amber B. Knappenberger, 34, of Jim Thorpe, had her parole revoked on four cases on petition of George for violating conditions by testing positive for opiates which violated the zero tolerance condition.Serfass resentenced her to serve 90 days in the county prison effective June 22.Joshua A. Gundry, 26, of Weatherly, had his parole revoked in three cases on charges of two counts receiving stolen property and one of theft on petition of Bettine for violating conditions by testing positive for opiates which violated the zero tolerance provision.Matika resentenced him to serve the balance of his sentence which runs to Oct. 7.Justin Mooney, 26, of Lehighton, had his parole revoked on a charge of theft on petition of McGinley for violating conditions by testing positive for opiates, failing to report for scheduled urine screen which violated the zero tolerance condition.Nanovic resentenced him to served the balance of his maximum, which runs to April 1, 2016. He was granted work-release privileges.David Eisenhower, 35, of Lehighton, had his parole revoked on a charge of possession of a controlled substance on petition of McGinley for violating conditions by failing to report to the probation office as directed and failing to report for scheduled urine screens.Nanovic resentenced him to serve six months back time in the county prison effective May 22.ARD revokedTwo people had their placement in the county's Accelerated Rehabilitation Disposition probation program revoked for violating conditions.Katelynn Solt, 22, of Lehighton, was revoked from the program on a charge of possession of a controlled substance for having new criminal charges filed against her.Tammy Newhart, 52, of Nesquehoning, was revoked from the program on a charge of driving under the influence for violating conditions by failing to complete drug and alcohol treatment and failing to complete 50 hours of community service.Each had their cases placed on the next available pretrial list.Tyquan Owens, 19, of Lansford, had his bail revoked and removed from pretrial services for violating conditions by failing to report to the probation office as directed, testing positive for a controlled substance, failing to submit to scheduled drug screens and failing to attend and complete drug and alcohol treatment.Bail was reset by Matika at $100,000 straight cash. Owens was then remanded to the county prison for failing to post the bail.
