Teen girl, boyfriend seek separate trials in mother's murder

ALLENTOWN (AP) - A 14-year-old girl and her soldier boyfriend are seeking separate trials on charges they conspired to kill the girl's mother last spring.

Jamie Silvonek and Army Spc. Caleb Barnes, 21, have each filed motions for separate trials, The (Allentown) Morning Call reported.The two are scheduled for a hearing Tuesday in the March stabbing death of Cheryl Silvonek, 54, in the driveway of her home near Allentown.Lawyers for Barnes argue that he cannot get a fair trial alongside the teenager because she has implicated him in the slaying. Her attorneys argue it would be improper to try a juvenile alongside an adult.Barnes' public defender, Richard Webster, also says many news stories focused on his client's military status and allegations that he had sex with a minor."The defendant believes ... that community sentiment is clearly against him, due in large part to the sensational news stories, both in local and national media," Webster said.Barnes is from El Paso, Texas, but was stationed at Fort Meade in Maryland.Both defendants also are asking that the trial be moved from Lehigh County because of the media coverage or a jury brought in from another county.Prosecutors charged the teenager as an adult, citing text messages in which they say Silvonek appeared to be trying to persuade Barnes to kill her mother, including one that read: "I want her gone."In the texts, the girl told Barnes that she was 17 and she asked him to deceive her mother about his own age.The teen's attorney, John Waldron, also has asked that the case be sent back to juvenile court. He said a hearing on that request won't be held this week because they are awaiting reports from examinations of his client.
