Junedale man sent to state prison for assaulting inmate
A Carbon County man was sentenced to a state prison term on Thursday for assaulting a fellow inmate at the county prison in Nesquehoning.
Zakary Michael Hunsinger, 22, of Junedale, Banks Township, was sentenced by Judge Joseph J. Matika to serve 12 to 24 months in a state correctional institution. The sentence was imposed on charges of assault on a prisoner and institutional vandalism.On a charges of simple assault and criminal mischief, stemming from an incident at the home of his brother, he was sentenced to serve six to 24 months in a state prison, concurrent with the first sentence.Hunsinger previously pleaded guilty to the charges.Nesquehoning police charged Hunsinger for an incident Feb. 8, 2014, at the prison.Police said Hunsinger assaulted his cellmate, Jeffrey Hosier, by knocking him to the floor and against a toilet in the cell. The force caused a head injury to Hosier that required medical attention. The toilet was ripped from the wall.The second case involved his brother, Derek Hunsinger, as the victim and occurred at the brother's home on March 11 in Tresckow, Banks Township.State police at Hazleton said the defendant entered the home of his brother without permission, damaging doors in the process.When confronted by his brother, he had a knife in his left hand and lunged at his brother. Derek Hunsinger was not injured in the incident.On Thursday defense attorney Matthew Mottola asked the court not to invoke the deadly weapon enhancement and keep his client in the county prison.Matika rejected that, stating, "I can't ignore the fact a knife was used in the incident."Matika did agree to make Hunsinger eligible for the state prison "boot camp" program. Boot camp is an intensive program for those addicted to drugs or alcohol and is run like a military operation. If a person successfully completes the program they get early release from prison.One violation of rules in the program would make the person no longer eligible and he would be sent back to the general prison population.In addition to the jail term, Matika ordered Hunsinger to pay total restitution for damages at the prison of $2,568.33 and $500 at his brother's home.Hunsinger must also get both drug and alcohol and mental health evaluations, zero tolerance imposed on D&A use, supply a DNA sample, pay court costs of about $1,000, have no contact with Hosier and to stay away from his brother's home.He was given credit for 148 days spent in prison to date on the charges.
