Mahoning man faiiled to have ignition lock

A Mahoning Township man who fell asleep in his car while parked in the Burger King parking lot has been charged with DUI.

Township police said that at 11:06 p.m. July 15, police received a complaint of a male sleeping in his vehicle while parked improperly in the Burger King lot on Route 443.The vehicle was parked sideways across spaces in front of the store. When police arrived, the driver was asleep with the vehicle running, and loud music was coming from the stereo.Officers were initially unable to wake the driver, and made entry through the passenger door. They detected a strong odor of an alcoholic beverage, and shut the vehicle off.They woke the driver, Andy McCoy, 38, who then refused to comply with officers. He laughed and grabbed the steering wheel.McCoy repeatedly refused to get out of the car. Officers had to use force to remove him from the car, and place him under arrest.A records check showed McCoy was required to have an ignition interlock system installed on any vehicle he drives. His vehicle did not have an interlock installed.McCoy refused a blood test, and has been charged with DUI, a misdemeanor; illegally operating a motor vehicle not equipped with ignition interlock, a misdemeanor; and resisting arrest, a misdemeanor.A preliminary hearing is scheduled for Sept. 9.
