Sentences in DUI cases
A Montgomery County man was sentenced to a prison term Monday afternoon on a driving under the influence charge.
He was one of six defendants who previously pleaded guilty to DUI and were sentenced by Judge Steven R. Serfass.William Peter Kuhn II, 50, of Royersford, was sentenced to serve 30 days in prison followed by 59 months in the county's Intermediate Punishment Program, with the first 60 days on electronic monitoring.Kuhn was arrested on Nov. 30, 2014, along Maury Road in Penn Forest Township by state police at Lehighton. A test showed 0.16 BAC.He was also ordered to pay a fine of $1,500, license suspended for 18 months and render 100 hours of community service when released from prison.Kuhn was given credit for 10 days spent in jail o the charges. He is currently serving a sentence in Montgomery County on another DUI.He will begin serving the remaining 20 days on the prison term on consecutive Tuesday to Thursday periods beginning Aug. 18. The IPP will be monitored by Montgomery County.Rafael Gonzalez, 51, of Allentown, was sentenced to serve 72 hours to six months in prison.He was arrested on June 19, 2014, along Route 209 in Franklin Township by state police at Lehighton. A test showed the presence of a controlled substance.He must also pay a fine of $1,000, have his license suspended for one year, and render 25 hours of community service.Peter James Huff, 24, of Tresckow, was sentenced to serve 72 hours to six months in jail.He was arrested on July 31, 2013, along Route 903 in Penn Forest Township by state police at Lehighton. A test showed the presence of a controlled substance.He was also ordered to pay a fine of $1,000, have his license suspended for a year and render 25 hours of community service.He will begin the jail term at 9 a.m. Aug. 15.Mark Edward Yanoski, 46, of Tamaqua, was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.He was arrested on Feb. 18, 2012, along Route 903 by Jim Thorpe police. A test showed a 0.15 BAC. It is a first offense.Steven Elmer Abendschein, 48, of Albrightsville, was placed on probation for six months, ordered to pay a fine of $300, and render 25 hours of community service.He was arrested Nov. 20, 2014, along Route 903 in Penn Forest Township by state police at Lehighton. A test showed 0.10 BAC. It is a first offense.Zachery M. Koehler, 29, of Northampton and formerly of Lehighton, was sentenced to serve 72 hours to six months in jail.He was arrested on Aug. 17, 2012, by Mahoning Township police along Route 209. A test showed the presence of a controlled substance. He also pleaded to one count of possession of drug paraphernalia.He was previously placed in the county's Accelerated Rehabilitation Disposition probation program for first-time offenders but was revoked for violating conditions.Serfass also ordered he pay a fine of $1,000, have his license suspended for a year and render 25 hours of community service. He was given credit for 58 days spent in an inpatient rehab center and paroled.On the drug charge he was placed on probation for a year, consecutive to the DUI charge, plus another 50 hours of community service.Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
