Sentences in drunken driving cases

Four defendants who previously pleaded guilty to driving under the influence, were sentenced Monday morning in Carbon County court.

President Judge Roger N. Nanovic II imposed sentences on the following:Wesley Lynn Behler, 24, of Lehighton, was sentenced to serve one to 18 months in prison on the DUI count and one to six months on a charge of unauthorized use of an automobile.He was arrested on Dec. 27, 2014, along Mauch Chunk Road by Palmerton police. A test showed the presence of a controlled substance.Behler is currently serving a prison term of six months for a probation violation.He was also ordered to pay a fine of $1,500 and license suspended for a year. The terms run concurrent with his probation violation.Kevin James Marion, 49, of Upper Darby, Delaware County, was sentenced to serve 90 days to five years in jail. He will serve 30 days in jail and 60 days in the county's Intermediate Punishment Program with electronic monitoring.He was arrested on Aug. 17, 2014, along Route 209 by Franklin Township police. Given a test, the result was 0.19 BAC.He was also ordered to pay a fine of $1,500 and license suspended for 18 months.He was given credit for 30 days spent in a inpatient rehab facility and paroled. The IPP will be monitored by Montgomery County, where he is currently serving a term on another DUI charge. Nanovic ruled his sentence is consecutive to Montgomery County.Prudence Elaine Greenawalt, 57, of Palmerton, was sentenced to serve 90 days to five years in prison. The first 30 days will be spent in jail followed by 60 days in the IPP with electronic monitoring.She was arrested on Sept. 20, 2014, along Main Lane by Lehighton police. A test showed the presence of a controlled substance.She was also ordered to continue mental health counseling, and zero tolerance imposed on D&A use.She will begin her jail term at 1 p.m. Aug. 16 and serve it on consecutive Sunday to Tuesdays. The IPP begins after she completes the jail term.Amber Lynn Tandy, 25, of Jim Thorpe, was sentenced to serve 90 days to five years in jail. She will serve 30 days in prison with the remaining 60 days in the IPP. She was also ordered to pay a fine of $1,500, license suspended for 18 months, and zero tolerance for D&A use. She was given credit for 32 days and paroled.Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
