Nesquehoning man sentenced to prison for fleeing and DUI

A Nesquehoning may was sentenced to a county prison term Monday morning on charges of fleeing or attempting to elude police and driving under the influence in two separate cases.

Samuel James Heydt, 37, was sentenced by President Judge Roger N. Nanovic II to a total of three months and five days to 18 months followed by one year of probation.Heydt previously pleaded to the fleeing charge, two counts of DUI and one count each of unauthorized use of an automobile and driving while under suspension.The first incident occurred on July 30, 2014, along Catawissa Street when Nesquehoning police attempted to stop Heydt for a traffic violation. Heydt did not immediately stop and traveled a further distance before pulling over. After exiting the vehicle he fled on foot but was apprehended.The second incident occurred on June 13, 2014, along Mermon Avenue when Nesquehoning police observed Heydt operating a red scooter that did not have a registration plate. Heydt did not stop and sped away and eventually went onto an off-road trail. A witness identified Heydt as the driver. Another count of fleeing or eluding was dropped in a plea bargain.Heydt told the court he recently completed a one-year jail term on July 31 on other charges.On the fleeing charge Nanovic imposed three to 12 months in prison followed by a year probation, a fine of $1,000, license suspension for a year, and he must supply a DNA sample. The court ruled the DUI count in that case merged with fleeing charge for sentencing purposes.On the second case, on a DUI count, Nanovic sentenced him to serve five days to six month in jail, a fine of $1,000, another year suspension with the term running consecutive to the first count.On the driving under suspension charge, he was fined $200.He will begin the jail term at 10 a.m. Aug. 31.
