A Tamaqua man will serve a sentence at home for driving under the influence with electronic monitoring.
Schuylkill County Judge John J. Domalakes on July 8 sentenced John Garrett, 48, to three to six months of home confinement due to a medical condition, beginning Aug. 16.Garrett, who pleaded guilty to the charge, will pay $50 a month toward the cost of the program, as well as other fees and court costs.Domalakes fined him $1,500 and his license is suspended for 18 months, followed by 12 months of ignition interlock. Garrett also must complete outpatient treatment.He was stopped on July 26, 2014, by Tamaqua police after making an illegal turn from Cedar onto Center Street at 1:20 a.m. Garrett smelled of alcohol and showed signs of intoxication, according to a police report. He admitted to drinking 30 minutes earlier and told police he was only out to "pick up a friend."In addition to the alcohol he had consumed, Garrett told the officer he had medical problems and had also taken multiple prescription medications, including Percocet and Vicodin, according to the report.He was given, and failed, field sobriety tests. A preliminary breath test indicated a 0.25 BAC, more than three times the legal limit of 0.08. Garrett refused to submit to blood tests.
