Defendants sentenced in DUI cases
Five defendants were sentenced on DUI charges Tuesday in Carbon County court by Judge Joseph J. Matika.
Felicia M. Urbanski, 27, of Tamaqua, was sentenced to serve 72 hours to six months in the county prison. She was arrested on Dec. 3, 2013, along Bertsch Street, by Lansford police. A test showed the presence of a controlled substance and also a 0.05 BAC.She was also ordered to pay a fine of $1,000, have her license suspended for a year, and render 25 hours of community service when released on parole.She is currently serving a probation violation prison term which runs to June 30, and also faces criminal counts in Schuylkill County.Matika ruled his sentence runs consecutive to her current sentence.Jacob Alan Stauffer, 23, of Lehighton, was sentenced to serve 30 days to six months in jail. He was arrested on July 12, 2014, in the area of 568 West Lizard Creek Road in East Penn Township by state police at Lehighton. A test showed 0.17 BAC.He was also ordered to pay a fine of $750, have his license suspended for a year, get a drug and alcohol evaluation, continue current treatment program, zero tolerance for D&A use, and render 25 hours of community service.He was given credit for 30 days spent in a inpatient rehab program and parole.Shane Garey, 33, of White Haven, was sentenced to serve 48 hours to six months in jail. He was arrested on July 17, 2014, along Route 940 by Kidder Township police. He refused a blood test and lost his license for a year for the refusal.Matika also ordered he pay a fine of $500, have his license suspended for one year, and render 25 hours of community service.He will begin the jail term at 6 p.m. May 29.Joseph J. Moyer Sr., 62, of Lansford, was sentenced to serve 72 hours to six months in jail. He was arrested on July 18, 2014, along Patterson Street by Lansford police. A test showed the presence of a controlled substance.He was also ordered to pay a fine of $1,000, have his license suspended for one year, continue outpatient treatment, and render 25 hours of community service.He will begin the jail term at 9 a.m. May 29.Michael D. Palka, 23, of Lansford, was sentenced to serve 72 hours to six months in jail. He was arrested on Dec. 22, 2012, along Route 209 by Lansford police. A test showed the presence of a controlled substance.Matika also ordered he pay a fine of $1,000, have his license suspended for one year, continue outpatient program, and render 25 hours of community service. He began the jail term immediately.All defendants must also pay court costs of about $1,000, and a $50 per month supervision fee while on probation or parole.
