A Philadelphia man was sentenced to a year in jail on Tuesday in Carbon County court on a drunken driving charge.
He was sentenced by Judge Joseph J. Matika on driving under the influence charges after previously pleading guilty.Christopher M. Levy, 32, was sentenced to serve one to five years for his sixth driving under the influence conviction.He was arrested on the latest charge on March 2, 2012, along Route 940 by Kidder Township police after being involved in a accident. A test showed 0.23 BAC.The sentencing date was continued a total of 12 times because Levy had entered inpatient rehabilitation programs.He was in a Salvation Army program in Philadelphia for eight months but was unsuccessfully discharged after he relapsed and consumed alcohol.A week later he entered a Salvation Army program in Trenton, New Jersey, and successfully completed a six-month inpatient term.Matika gave him credit for 184 days spent in the Trenton program but said he would receive no credit for the Philadelphia placement because he did not successfully complete it.Matika also ordered Levy to pay a fine of $1,500, have his license suspended for 18 months, zero tolerance for D&A use, and continue is current outpatient counseling program.Levy will serve 45 consecutive two-day weekends beginning May 22 at 7 p.m. After that he will serve three months straight time in the county prison. Matika noted with the credit for the rehab time, Levy still must serve about six months in prison.
