Defendants enter pleas in theft cases

A total of four defendants entered guilty pleas in theft-related cases on Thursday in Carbon County court.

Judge Steven R. Serfass accepted pleas from the following:James Patrick Holler, 20, of Saylorsburg, pleaded to one count of criminal conspiracy-retail theft.He was arrested on April 3, 2013, for an incident at the AT&T store along Blakeslee Boulevard in Mahoning Township. He was involved in the theft of two iPhones, township police said. A juvenile was also involved in the incident.Holler was previously placed in the county's Accelerated Rehabilitation Disposition probation program for first-time offenders but was revoked from it for violating conditions.Serfass placed him on probation for 18 months and ordered he render 75 hours of community service. The phones were recovered.Jennifer M. Walker, 36, of Palmerton, pleaded to one count of retail theft, a felony. She was arrested by Palmerton police for an incident at the Dunkin' Donuts at 555 Delaware Ave., on March 26. She too $8.99 worth of merchandise.Before accepting her plea, Serfass conducted a probation revocation hearing as Walker was on probation for two prior retail theft convictions when the third one occurred.Walker admitted to the violations. She is in the county prison on the probation violations.Serfass resentenced her on the probation violation to serve six to 12 months in the county prison and must obtain a mental health evaluation.On the new theft charge Serfass placed her on probation for 24 months, consecutive to the jail term, and ordered her to supply a DNA sample and render 100 hours of community service when released on parole.Bruce Michael Meixsell, 24, of Lehighton, pleaded in two pending cases of one count each of criminal trespass, as a summary offense, and theft.He was charged with the theft count for an incident on Feb. 19 when he removed a propane heater from his mother's residence at 240 Union Hill Road, Franklin Township. The heater was recovered.He was charged with the trespass count for an incident on Feb. 20 at his mother's home.Township police charged he was at the residence after previously being told he was not allowed to be there.On the trespass count Serfass sentenced him to serve 42 to 84 days in jail and gave him credit for 84 days already served, and he was paroled. On the theft charge he was placed on probation for 24 months consecutive to the first count.He was also ordered to get a drug and alcohol evaluation, render 100 hours of community service, and to stay away from his mother's home.Garry Marshall Hoffner, 37, of Palmerton, pleaded to one count of retail theft. He was arrested on Feb. 13 by Palmerton police for an incident at the Family Dollar Store at 534 Delaware Ave. He took merchandise valued at $7.75.He was placed on probation for a year and ordered to render 50 hours of community service.Each defendant must also pay court costs of about $1,000, and a $50 per month supervision fee while on probation or parole.
