Tamaqua man waives hearings in three cases
A Tamaqua man had three court appearances scheduled before District Judge Stephen Bayer, of Tamaqua, last week and elected to waive all three of the preliminary hearings and wait for his cases to be heard in Schuylkill County Court.
John Leroy Smith II, 25, of 385 Owl Creek Road, was in court for hearings on charges filed by Coaldale police. In two of the cases, the charges were filed by Sgt. Keith Krapf. In the third, the arresting officer was patrolman Joseph David.Smith was charged with theft by unlawful taking, receiving stolen property, conspiracy to receive stolen property and defiant trespass after a June 1, 2014, incident. Charges of possession of drug paraphernalia, disorderly conduct, defiant trespass by communication and criminal mischief in connection were filed after an Oct. 22, 2014, incident. And a charge of defiant trespass by communication was filed after an Oct. 28, 2014, incident.Smith was released on his own recognizance in all three cases.Two other defendants had preliminary hearing scheduled in multiple cases.Alexandra Perez, 24, of 44 E. Mauch Chunk St., Tamaqua, waived hearings in three cases, all with charges of theft by deception and receiving stolen property. Charges were filed by Rush Township patrolman Adam Sinton after the Oct. 28 and 30, 2014, incidents and by Rush patrolman Jeffrey Tanner after a Nov. 11, 2014, incident.She was released on her own recognizance in all three cases.Colin S. McGregor, 25, of 212 Bowe St., Tamaqua, was scheduled for two hearings, but failed to appear in court. Charges in both cases were filed by Tamaqua patrolman Karl Harig. They include making terroristic threats, repairing/selling an offensive weapon, simple assault, harassment and disorderly conduct stemming from a Jan. 23 incident and defiant trespass by communication from a Jan. 29 incident.A warrant could be issued for McGregor's arrest.DUI casesA number of defendants were scheduled for hearings on charges related to driving under the influence. Of those who appeared in court, all of the defendants chose to waive their hearings to the county level.Julia Marie Evans, 23, of 422 Boone St., Pottsville, failed to appear for her hearing on charges of DUI of a controlled substance, possession of drug paraphernalia and littering. The charges were filed by Coaldale patrolman Charles Blesse after a Nov. 26, 2014, incident.All of the charges were bound over for court, and a warrant could be issued for her arrest.Anthony William Adams, 18, of 13 W. Cherry St., Tresckow, waived his hearing on charges of four counts of DUI of a controlled substance and operating unsafe equipment. The charges were filed by McAdoo patrolman William Curilla after a Jan. 30 incident.He was released on his own recognizance.Sarah Elizabeth Trotman, 22, of 330 Arlington St., Tamaqua, was charged with four counts of DUI of a controlled substance, possession of marijuana, disregard of the single traffic lane and operating unsafe equipment. The charges were filed by Rush Township patrolman Alexander Kosatschkow after a Sept. 12, 2014, incident.She released on her own recognizance.Anthony Ades Jr., 36, of 611 Pine St., St. Clair, was charged with DUI (alcohol) and failure to use required lights. The charges stem from a Feb. 2 incident and were filed by Tamaqua patrolman Thomas Rodgers.Ades was released on his own recognizance.Nicholas Martinez, 22, of 62B Hunter St., Tamaqua, was charged with DUI of a controlled substance (three counts), possession of marijuana, driving with a suspended license and driving without headlights. Rush Township patrolman Sinton filed the charges after an Aug. 23, 2014, incident.He was released on his own recognizance.Christopher A. Arcand, 23, of 49 Mazur Lane, Tamaqua, was charged with two counts of DUI (alcohol), driving an unregistered vehicle and disregard of a single traffic lane. The charges stem from a Jan. 16 incident and were filed by Rush Township Sgt. Duane Frederick.Arcand was released on his own recognizance.Autumn Cleary, 31, of 62 N. Sheridan St., McAdoo, was charged with three counts of DUI of a controlled substance and careless driving by McAdoo patrolman Justin Farley. The charges stem from a Nov. 15, 2014, incident.She was released on $10,000 unsecured bail.
