Man faces indecent assault charges
Charges against a Berks County man accused of the indecent assault of a child have been bound over for court.
Michael Held, 41, of Kutztown, was scheduled to have a preliminary hearing Tuesday before District Judge William Kissner of Palmerton.Instead, Held waived his right to a preliminary hearing and opted for a waiver to guilty plea on charges of two counts of indecent assault.In addition, Held must have a mental health evaluation, and follow whatever recommendations result from that evaluation.Held is scheduled to appear at 1:15 p.m. May 28 for his guilty plea in the district attorney's office at the courthouse in Jim Thorpe.He remains free in lieu of $150,000 unsecured bail.According to the affidavit filed by Detective Kevin Buck of the Palmerton Police Department:On Jan. 5, Buck received a notification from Northampton County Child Services about an act of sexual abuse of a child that had occurred in Palmerton a few years before.On Jan. 8, a 15-year-old male arrived at the Palmerton Police Department and an interview was conducted. The teen said he had been having some emotional issues and came to the conclusion that a big contributor was he had never told anyone what had happened to him.The teen said he could not remember exactly how old he was when it happened, but said it occurred at a Lafayette Avenue residence on the second floor either four or five years ago.The teen said while he was visiting his grandmother, who lived in the downstairs portion of the home, he would ask to go upstairs and hang out with Held, who was his half sister's cousin's father.The teen said they would often watch television together and play video games.Buck asked if Held had ever shown any signs of something like this happening. The teen said there was no precursor to these events, and that one day they were hanging out and Held was wearing basketball shorts and exposed his private area.The male said Held was touching himself for a while, and then told the male to begin touching himself, and at one time said, "I have mine out why not take yours out."The teen said no one was ever around when it happened.The teen said that as he did what Held had told him to do, Held would laugh and the teen would continue because he felt he was making Held happy.The teen said he went along with it because he looked at Held like an uncle, and felt that he should listen to him.Buck asked if Held had ever threatened him or told him not to tell anyone.The teen said Held told him if anyone ever found out, that something would happen to him, and that he had done this to a girl before him, except it was much worse.The teen said it happened two times a few weeks apart, with the second time being similar to the first one.Buck asked if Held ever filmed or took pictures of him, and the teen said there was a digital camera, but as far as he knew, Held only took pictures of himself.Buck contacted Held on Jan. 14, and Held said he wanted to speak to an attorney first.On Feb. 6, attorney Allan Sodomsky, who represents Held, told Buck his request for an interview was being denied.
