Four sentenced on DUI charges

Four defendants who previously pleaded guilty to driving under the influence charges and related offenses were sentenced Monday in Carbon County court.

Judge Joseph J. Matika imposed sentences on the following:Brad A. Osborn, 21, of Nesquehoning, was sentenced to serve 48 hours in jail, followed by five months and 28 days in the county's Intermediate Punishment Program with the first 28 days spent on electronic monitoring. He was also ordered to pay a fine of $750, have his license suspended for a year, render 25 hours of community service, have zero tolerance imposed on D&A use, and successfully complete his outpatient counseling program.On two summary motor vehicle code violations he was fined a total of $225.He will begin the jail term on April 1 at 9 a.m.Osborn was arrested on Aug. 17, 2013, along Main Street by Weatherly police. A test showed 0.13 BAC.Sean Richard O'Brien, 26, of Blakeslee, was sentenced to serve 30 days to six months in jail.He was also ordered to pay a fine of $750, have his license suspended for a year, render 25 hours of community service when paroled, zero tolerance for D&A use, and successfully complete his outpatient counseling program.O'Brien is currently serving a parole violation sentence on a prior DUI in Monroe County that runs out at the end of June. Matika ruled his sentence runs concurrent with the Monroe term.O'Brien was arrested on July 19, 2014, along Route 903 by Kidder Township police. A test showed 0.13 BAC.Matthew Karl Stoffan Jr., 31, of Whitehall, was placed on probation for six months and ordered to pay a fine of $300, render 25 hours of community service, and successfully complete his outpatient counseling program.On a charge of possession of drug paraphernalia, he was placed on probation for six months, concurrent with the DUI charge.He was arrested on March 29, 2014, by Mahoning Township police along Blakeslee Boulevard Drive West. A test showed 0.16 BAC.Charles A. Matusick, 58, of Weatherly, was placed in the IPP for six months with the first 20 days on electronic monitoring. He was also ordered to pay a fine of $300, have his license suspended for one year, render 25 hours of community service, and have zero tolerance imposed on drug and alcohol use.He was arrested on Sept. 4, 2014, along West Main Street by Weatherly police. A test showed 0.14 BAC.ARD placementSteven Neil Spaide, 43, of Freeland, was placed in the county's Accelerated Rehabilitation Disposition probation program for first-time offenders on a charge of DUI. He was arrested on June 7, 2014, by state police at Hazleton along Buck Mountain Road in Lausanne Township following his involvement in a hit-and-run accident. A test showed 0.20 BAC.He was assessed $650 for the cost of the program, ordered to render 50 hours of community service, and his license was suspended for 60 days.He originally pleaded guilty to the charge after he was initially denied placement in the ARD program because of a prior DUI charge that showed up on his record. However, a records check showed he was not charged with DUI in the other case but underage drinking and theft. He then became eligible for the ARD program under county rules.Each defendant must also pay court costs of about $1,500, and pay a $50 per month supervision fee while on parole or probation.
