Lehighton man gets state prison on theft charges
A Carbon County man was sentenced to a state prison term on Monday in three cases, all involving theft-related counts.
Kyle Hagenbuch, 20, of Lehighton, was sentenced by Judge Joseph J. Matika to serve a total of six to 12 months in a state correctional institution on charges of access device fraud and receiving stolen property. The prison term will be followed by two years of probation.Hagenbuch was made eligible for the state boot camp program. The program is a strict, military-run type program that includes time spent in prison, placement in rehabilitation programs, and then release to a halfway house. Before being sentenced, Hagenbuch pleaded guilty to one count of receiving stolen property. He admitted receiving a stolen iPhone and then selling it. That incident occurred on July 29 in Lehighton. He previously pleaded to access device fraud for taking a credit card of another person and using it at the Walmart store in Mahoning Township. His arrest on the receiving charge prompted the adult probation office to file a probation revocation petition against him in another theft case.Hagenbuch told Matika his run-ins with the law were not due to drug abuse of addiction. He said he has never been involved in drug use. He claimed his criminal history was due to such factors as how he was brought up and the people he hung around with.Matika told him the boot camp is not easy, and if he fails to complete it he will serve the full prison term imposed. Before the sentencing on the other counts Matika conducted a probation revocation hearing in which Hagenbuch admitted he violated the terms of his probation. On the revocation case Matika ordered him to serve 239 days "back time" consecutive to the six to 12 months on the other charges. He was given credit for 109 days on that charge and 25 days credit on the other two counts. He was also ordered to render 50 hours of community service when released on parole, make restitution of $239.62, and pay court costs of about $1,000.
