Two defendants fail to appear for hearings; others waive cases

Two defendants failed to show up, another had three separate cases scheduled and the rest all waived preliminary hearings before District Judge Stephen Bayer of Tamaqua last week.

Jonathan Edward Evanco, 21, of McAdoo, was scheduled to appear before Bayer on theft and drug-related cases filed by McAdoo police in connection with three incidents, but failed to appear in court. All three cases were held over for court trial.A warrant could be issued for his arrest.Alysha Taylor Lynne Wilcox, 22, of McAdoo, also failed to appear in court. She was scheduled for a hearing on charges of theft and receiving stolen property, filed by McAdoo patrolman Anthony DiVirgilio after an Aug. 28 incident.A warrant could be issued for her arrest.Joseph Vigna, 51, of McAdoo, did appear in court, electing to waive his right to a hearing in three separate cases Sept. 30. Oct. 2 and 3. The charges in all three cases were burglary, criminal trespass, theft by unlawful taking, receiving stolen property, and criminal mischief. The Oct. 2 charges were filed by Rush Township police, while the other two cases are from Kline Township.Bail in each case was set at $10,000 percentage, which Vigna was able to post.Terri L. Kates-Fairchild, 34, of Tamaqua, waived a hearing on charges of manufacture/possession of a controlled substance with intent to deliver, possession of a controlled substance and criminal use of a communications facility. She was charged by Tamaqua patrolman Anthony Stanell after an Oct. 30 incident.She was released on $10,000 unsecured bail.Others who waived charges included:Hubert Budd, 21, of Tamaqua, was charged with driving under the influence of alcohol (0.16 BAC or greater); purchase of alcohol by a minor (the incident took place before his 21st birthday); disregarding a traffic lane; and careless driving. The charges were filed by Coaldale patrolman Joseph David following a June 22 incident.Budd was released on his own recognizance.Torrey S. Mueller, 38, of Tamaqua, was charged with DUI of a controlled substance, driving at an unsafe speed and failure to heed a stop sign. The charges were filed by Tamaqua patrolman Corey Herring after a July 4 incident.Mueller was released on his own recognizance.Thomas Alvin Heiser, 34, of Coaldale, was charged with possession of drug paraphernalia and disorderly conduct by Tamaqua Cpl. Dwayne Hacker after a May 2 incident.Heiser was released on $10,000 unsecured bail.Michelle Roth Lager, 38, of Tamaqua, was charged with theft by unlawful taking by Tamaqua patrolman Michael Hobbs. The charges stem from a Sept. 17 incident.She was released on her own recognizance.Todd Michael Stephan, 39, of Mahanoy City was charged with making unsworn false statements to authorities and making a false statement under penalty. A charge of making a false statement in connection with the purchase, delivery, or transfer of a firearm was withdrawn by arresting officer state trooper Michael Allar. The charges stem from a March 12 incident.Stephan was released on $10,000 unsecured bail.
