Schuylkill County Judge James P. Goodman on Oct. 13 revoked the a Tamaqua man's probation and sent him to state prison.

Joseph B. Franz, 27, Tamaqua violated the conditions of his probation program on Aug. 14 when police found drugs in his car after a crash. Franz had been sentenced to probation on April 24, 2013 on charges of forgery, theft and conspiracy filed Nov. 8, 2012 by Tamaqua police.Goodman sentenced him to up to 30 months in state prison, with credit for 61 days he's already served.Details of the forgery arrest were unavailable.In other court rulings, Judge Jacqueline L. Russell has given three local people a second chance by admitting them into a program that can wipe their records clean if they successfully complete it. The Accelerated Rehabilitative Disposition program is for first time offenders accused of non-violent crimes. The defendants are required to pay court costs and fees.Matthew Hummel, 32, Frackville: Charged on Oct. 19, 2013 by Rush Township police with two counts of driving under the influence of a controlled substance and driving without headlights.Russell admitted Hummel into the ARD program for 12 months, suspended his license for 60 days and ordered him to perform 10 hours of community service. He has to pay $460 in restitution to Schuylkill Medical Center, complete Alcohol Highway Safety School and enroll in outpatient substance abuse treatment.The charge of driving without headlights was dropped.Sean Scott, 38, Tamaqua: Charged on July 1, 2012 by Tamaqua police with 34 counts of forgery, two counts of theft by deception, theft by unlawful taking, and two counts of receiving stolen property. Russell accepted Scott into ARD for 24 months, ordered him to pay $7,830 in restitution to First Niagara Bank, $1,803 to one victim, and $1,951 to another.Scott was also ordered to serve 20 hours of community service.Alyssa Bensinger, 26, Tamaqua: Charged on June 5, 2013 by Rush Township police with simple assault and retail theft. Russell placed Bensinger in the ARD program for 12 months, and ordered her to perform 10 hours of community service. She must also undergo anger management evaluation and comply with any recommended treatment; she was ordered to stay away from the victim.Kelly Gothard, 38, New Ringgold: Charged on Dec. 18, 2013 by Kline Township police with possession of a small amount of marijuana. Russell placed her in ARD for 12 months and ordered her to perform 10 hours of community service.
