A Walnutport man was sentenced to a state prison term on Thursday on a charge of fleeing or attempting to elude police.
John Duncan Holzer, 41, was sentenced by Judge Joseph J. Matika to serve 14 to 28 months in a state correctional institution.Holzer was convicted by a jury on Aug. 4 of fleeing Palmerton police during the early morning hours of Jan. 13, 2012. Holzer represented himself at the trial and also at yesterday's sentencing proceeding. Before imposing the sentence, Matika asked Holzer if he wanted to apply for a public defender to represent him for sentencing, but the defendant declined.Officer Robert Cohowicz, then of the Palmerton police and now an officer with the Stroud Regional Police Department in Monroe County, testified at the trial that he first encountered Holzer at the intersection of Lafayette Avenue and Sixth Street when he failed to stop for a stop sign and almost struck Cohowicz's patrol unit.A chase then ensued along Lafayette Avenue with speeds reaching 70 mph in a 25 zone. Holzer also failed to stop at several stop intersections during the chase.Cohowicz lost sight of Holzer for a time but later learned he was at a residence in Palmerton and took him into custody.Holzer has been in the county prison since his arrest the day of the incident. In addition to the jail term, Matika ordered Holzer to get a drug and alcohol evaluation and follow any recommendation for treatment, supply a DNA sample, render 50 hours of community service when released on parole, and pay court costs, which average about $1,000.On three motor vehicle code violations, which he was found guilty of by Matika following the trial, he was fined a total of $250.He was given credit for 215 days spent in jail on the charges.
