Judges rule on local defendants

A Schuylkill County court judge has revoked the parole of a Tamaqua man charged with stealing from a Mahoning Township electronics store.

President Judge William Baldwin on March 20 revoked bail for Alexander Modawar, 33. The 28 days that Modawar was on parole will be tacked on to his sentence, with credit given for the 32 days, from Feb. 7 through March 11.Modawar may apply again for parole on May 16, with the condition that he be accepted into an inpatient rehabilitation facility.According to court documents, Modawar was charged with retail theft on Aug. 30 when he stole two hand-held radio scanners worth $699.98 from the Radio Shack along Route 443.Modawar had three prior retail theft convictions, so he was charged with a felony offense.On March 19 Baldwin sentenced Ashley Bynon, 20, of Tamaqua, for her participation in an altercation in that borough on April 16.Bynon, along with two other women, attacked Nicole Hazlett, who suffered head injuries, a cut inside her mouth, and bruising around her right eye.Bynon was charged with simple assault, reckless endangerment, and disorderly conduct.Baldwin sentenced her to pay a monthly $50 supervision fee; $50 to the Criminal Justice Education Account fund; serve 23 months of probation; have no contact with the victim; undergo a drug and alcohol evaluation and successfully complete any recommended treatment; and serve 10 hours of community service.On March 21 Judge Charles M. Miller dissolved a bench warrant that had been issued for Cody Lee Adams, 23, of Port Carbon. Adams, charged Nov. 10 for stealing and cashing in lottery tickets from a minimarket in the borough, was freed on $10,000 unsecured bail.He must abide by a set of conditions, including that he must live at 5 E. Washington St., Port Carbon, and may not relocate without written permission from the district attorney; he may not possess or consume alcoholic beverages, controlled substances or drug paraphernalia; he may not travel outside the state without written permission from the district attorney; and he must submit to random drug screenings administered by the Adult Probation department.On March 21 Miller also modified bail conditions for Zachary L. Kabana, 20, of Tamaqua.Kabana, who then lived in New Philadelphia, was charged Dec. 30 with aggravated and simple assault and recklessly endangering another person in a Dec. 26 incident. He was released on $5,000 unsecured bail.The condition levied by Miller is that Kabana must live at 23 W. Spruce St., Tamaqua.
