Man faces drug, theft charges in two cases

Lansford police have charged a borough man with drug and theft offenses stemming from two incidents.

Kyle Nalesnik, 27, of 146 W. Patterson St., faces possession of a controlled substance in connection with an incident on Feb. 14, and charges of felony retail theft and receiving stolen property from an incident on Feb. 6.According to affidavits of probable cause filed by officers Jason A. Helmer and Joshua Tom with District Judge Casimir Kosciolek of Lansford, here's what happened:At 5:50 p.m. Feb. 14, Helmer was on patrol in the 500 block of East Bertsch Street when he encountered a man walking in the street. Helmer recognized him as Nalesnik and knew there was a warrant out for his arrest on charges of felony retail theft and receiving stolen property.He stopped Nalesnik, told him about the warrant and arrested him.Before putting Nalesnik in the cruiser, Helmer patted him down. Asked if he had anything on him that Helmer should be aware of, Nalesnik mentioned that he had some pills in his pocket.Helmer found a clear plastic bag with three pills, two of which were in a cigarette wrapper. Nalesnik told him the pills were "morphine 100s" and a "Xanny bar," neither of which he had a prescription for.He took Nalesnik to the police station and read him his Miranda warnings. Nalesnik opted to not waive his warnings, telling Helmer "I already told you the truth."The pills were identified through a pill identifier database as two 100 milligram morphine sulfate extended release tablets and one 2 milligram alprazolam tablet, both controlled substances.Nalesnik was arrested, arraigned and jailed under $3,000 bail on the warrant charges of retail theft and receiving stolen property.In the Feb. 6 incident, Officer Tom stopped at the Turkey Hill mini mart at 11:50 p.m. As he opened the front door, Nalesnik was there, hands in his pockets. Helmer saw "something orange" sticking out from along Nalesnik's forearm.The store clerk indicated to Helmer that he should check Nalesnik's pockets. Helmer confronted Nalesnik outside the store as he was starting to leave. He asked Nalesnik to empty his pockets, and Nalesnik did.Nalesnik apologized, as Helmer had often warned him about stealing from stores. It turned out he had shoplifted $9.38 worth of items from the store.
