A McAdoo man failed to appear for his preliminary hearing before District Judge Stephen Bayer, of Tamaqua, this week, but the magistrate allowed the case to proceed, deciding there was enough evidence for a court trial.

Patrick B. McCarthy, 30, of 722 S. Kennedy Dr., was scheduled to appear before Bayer on charges of possession of a controlled substance and possession of drug paraphernalia. The charges were filed by Kline Township Police Chief John Petrilla following a May 9 incident.A number of defendants elected to waive their rights to preliminary hearings.David Joseph Halaburda, 29, of 11 Hotel Lane, Barnesville, was charged with burglary, criminal trespass, access device fraud, theft by unlawful taking, and receiving stolen property. The charges stem from a June 19 incident and were filed by Rush Township Police Sgt. Duane Frederick. The burglary charge was withdrawn.He was released on $35,000 unsecured bail.Jesse Becker, 27, of 415 N. Railroad St., Tamaqua, will face court trial on charges of theft by deception, receiving stolen property, conspiracy to commit theft by deception, and driving with a suspended/revoked license. The charges were filed by Sgt. Frederick following a Sept. 9, 2012, incident.Becker was released on his own recognizance.Patrick R. Ellison II, 29, of 127 E. Third St., Mifflinville, was also charged by Sgt. Frederick. Charges stem from an April 24 incident and include retail theft, receiving stolen property, defiant trespass, driving with a suspended/revoked license, and failure to stop at a stop sign.Ellison was released on $10,000 unsecured bail.Sophia Marie Covach, 24, of 322 W. Poplar St., Shenandoah, was charged with retail theft and receiving stolen property following a July 5 incident in Hometown. The charges were filed by Rush Township Patrolman Bradley Hess.She was released on her own recognizance.Ashley Blum, 22, of 111 Gay St., Tamaqua, will face trial on charges of theft of leased property, and receiving stolen property. The charges were filed by Officer Hess following a Jan. 26 incident in Rush Township.She was released on her own recognizance.Samantha L. Richardson, 23, of 2 Teaberry Lane, New Ringgold, was charged with access device fraud, theft by unlawful taking, and receiving stolen property by Tamaqua Cpl. Henry Woods. The charges stem from a June 4 incident.She was released on her own recognizance.John Smith II, 24, of 216 Owl Creek Rd., Tamaqua, was charged with retail theft, and public drunkenness following a May 24 incident. The charges were filed by Tamaqua Patrolman Joseph Krebs.Smith was released on $10,000 unsecured bail.Nathaniel Davis Jr., 62, of 222 E. Broad St., Tamaqua, was charged with driving under the influence (DUI) of alcohol and failure to drive at a safe speed following a May 10 incident in Tamaqua. He was charged by Patrolman Krebs.Davis was released on his own recognizance.Ashley M. Sist, 27, of 27 N. Manning St., McAdoo, had a charge of robbery withdrawn but will face court trial on charges of theft by unlawful taking, receiving stolen property, and disorderly conduct. The charges were filed by McAdoo Police Chief Jeffrey Wainwright following a June 26 incident.She was released on $10,000 unsecured bail.Jay Nicholas Beil, 38, of 301 W. Broad St., Tamaqua, had charges of simple assault and harassment withdrawn, while charges of disorderly conduct and public drunkenness were moved to nontraffic citations. The charges were filed by Tamaqua Patrolman Thomas Rodgers following a June 26 incident.Melissa Bailey, 33, of 12 W. Broad St., Tamaqua, had one count of disorderly conduct withdrawn while a second count of disorderly conduct was moved to a nontraffic citation. The charges were filed by Coaldale Patrolman Joseph Krebs following a July 20 incident.
