Bucks man given jail sentence; was hungry and stole $5 worth of cheese

A Bucks County man told Carbon County President Judge Roger Nanovic he was homeless and hungry when he stole $5 worth of cheese from a Palmerton bar.

Carlo Frank, 64, of Richlandtown, admitted to the theft on Thursday. Nanovic accepted his plea, and sentenced Frank to 53 days to one year in jail, but gave him credit for the 53 days he's already served.Frank will be returned to Bucks County, where he'll likely go to state prison as he was on parole for a 2009 offense when he stole the cheese from 110 Tavern, Palmerton, on May 19.Frank, who has a lengthy criminal history, was charged with receiving stolen property. He told Nanovic he had worked at the bar, but had lost his job a couple of weeks earlier."I just wanted to make a sandwich," he said.Frank said he was sorry for what he had done, and admitted that the bar owner would probably have helped him had he only asked.Frank's was one of 11 guilty pleas Nanovic accepted Thursday. The others were:Michael Jackson, 21, of Philadelphia, pleaded guilty to an escape charge stemming from a Feb. 15, 2012 incident. Jackson, then confined to the Youth Forestry Camp in Carbon County, failed to return after a camp bus trip to Wilkes-Barre for a basketball game.Nanovic sentenced Jackson to 11 days to one year in jail, with credit given for the 11 days he's already served. Jackson must also undergo a drug and alcohol evaluation, and pay a $50 monthly supervision fee and court costs.Jesse M. Becker, 27, of Tamaqua, pleaded guilty to possession of a controlled substance (heroin). He was arrested Aug. 28, 2010, by Summit Hill police in the area of Chestnut and Hazard streets.Nanovic sentenced Becker to one year of probation. He must also obtain a drug and alcohol evaluation. Nanovic levied a zero tolerance requirement for drugs, with random urine screenings. Becker must also pay court costs and fees.Richard Thomas Marsteller, 47, of Palmerton, pleaded guilty to possession of a controlled substance (marijuana plants), at his home at 7 Little Gap Road, Lower Towamensing Township. He was arrested on Aug. 11, 2011, by state police at the Lehighton barracks.Nanovic sentenced Marsteller to six months to a year, with credit given for the 46 days Martseller has already served. He must undergo a drug and alcohol evaluation, and adhere to a zero tolerance requirement, with random urine screenings. Marsteller must also pay a $50 monthly supervision fee and court costs.Anthony Joseph Mongi, 58, of Summit Hill, pleaded guilty to possession of a small amount of marijuana. He was arrested on May 22 along Old Mill Road at Beltzville State Park by park rangers.Nanovic sentenced Mongi to six months probation; zero tolerance for drug use, with random urine screenings; and obtain a drug and alcohol evaluation. Mongi must also pay court costs and fees.Alan M. Predmore, 49, of Jim Thorpe, pleaded guilty to DUI. He was arrested by state police at the Lehighton barracks June 2, 2012 along Behrens Road in Penn Forest Township. His blood alcohol content was 0.30. It was his second offense.Nanovic sentenced Predmore to 30 days to six months in jail, but gave him credit for six months he spent in a rehabilitation program. He also fined Predmore $1,000, suspended his license for a year, required him to obtain a drug and alcohol evaluation, and to pay court costs and fees.Jason Anthony Bender, 26, of Palmerton, pleaded guilty to two counts of criminal attempt- theft. He was arrested July 29 by Palmerton police. Bender took a truck belonging to Joshua Barkanic of Palmerton.Nanovic sentenced Bender to two concurrent sentences of six months probation. He must undergo a drug and alcohol evaluation, and adhere to a zero tolerance requirement, and pay court costs and fees.Troy D. Dubois, 42, of Palmerton, pleaded guilty to recklessly endangering another person. He was arrested July 1 by Palmerton police. Dubois deliberately released fuel oil into the basement at 766 W. Edgemont Avenue during a domestic dispute. A charge of risking a catastrophe was dropped during plea negotiations. Dubois was committed to a mental health unit after the incident.Nanovic deferred sentencing.Corey Scott Scherer, 21, of Palmerton, pleaded guilty to the same charges in the same incident as Fatzinger. The charge of endangering the welfare of a child was dropped in plea negotiations in exchange for a charge of possession of drug paraphernalia. he was on probation for another offense at the time.Nanovic sentenced Scherer to 43 days to a year in jail, with credit given for the 43 days he's already served. Scherer must also undergo a drug and alcohol evaluation, pay a $50 monthly supervision fee, and court costs..Mark Thomas Slotterback, 46, of Andover, New Jersey, formerly of Sweet Valley, Luzerne County, pleaded guilty to boating under the influence of alcohol on June 15, 2008, at Beltzville State Park, Lower Towamensing Township. He was arrested by park rangers. His blood alcohol content was 0.20.Nanovic sentenced Slotterback to six months of probation. He must also undergo a drug and alcohol evaluation, pay a $300 fine, and have his boating license revoked for six months. Slotterback also must take the state Fish and Boat Commission's boating safety course, and pay court costs and fees.Richard Fiore, 42, of Lehighton, pleaded guilty to DUI. It was his second such offense. The charge stemmed from a rollover accident on July 20, 2012 on Route 895 and Church Road. His blood alcohol level was 0.29.Nanovic deferred sentencing.
