Summary appealsA Tamaqua area woman won a partial victory in her appeal from the ruling made by a magisterial district judge on a motor vehicle code violation.Patricia C. Volosky, 59, of 106 Buck Run Road, was adjudged guilty by the district judge of meeting and overtaking a school bus on Spruce Street, Tamaqua, last March 8 as was charged by Patrolman Peter R. Wysochanksy Jr.After a hearing Judge Charles M. Miller reduced the charge to a traffic light violation and reduced the fine from $250 to $25.Angelia Seliga, of 401 S. Kennedy Drive, McAdoo, was found not guilty by Judge James P. Goodman of the charge of driving while her license was suspended.At the court hearing Seliga explained she had not been aware her license was suspended because of a motor vehicle code violation in New York State and had paid the fine and that her license was restored when cited in McAdoo last November.Leroy Paul Arthur, 46, Ashland, had his costs reduced from a charge of driving while his driver's license was suspended from $500 to $200 by Judge Miller. He was stopped last Feb. 13 on Interstate 81 in Butler Township.Dismiss chargesPresident Judge William E. Baldwin entered a nolle prosequi order dismissing criminal charges against three defendants after District Attorney Karen Byrnes Noon filed motions to dismiss because in two of the cases the victim did not wish to continue prosecuting.Rodney Alan Trego, 28, Pottsville, had charges of simple assault dropped because the victim did not wish to proceed with prosecution. The charge was brought by Ashland Chief Adam Bernodin.William John Murphy, 45, Pottsville, had charges of simple assault and harassment dismissed because the victim did not wish to prosecute because she wants to remain in a relationship with the defendant. The charge was filed by Schuylkill Haven Patrolman Paul R. Olson, after investigating a domestic dispute.A charge of driving under the influence (DUI) of alcohol filed against Larry J. Snyder, 68, Ashland, were dismissed because he has since died since the incident. The charge was filed by Pottsville Patrolman Kirk A. Becker.Pleads guiltyTravis James Riegel, 28, Schuylkill Haven, pleaded guilty to harassment his girlfriend, Brandy Eiler.He was ordered by Judge Charles M. Miller to pay a fine of $50, pay $50 to the Criminal Justice Enhancement Account and $50 to the district attorney's office for a bench warrant. He also was ordered to complete the Anger Management Program. Riegel was cited by Patrolman Gregory S. Meisner.Defer sentencesThree defendants who entered guilty pleas to criminal charges before Judge Charles M. Miller had their sentences deferred to Thursday, Oct. 3, as the court requested a pre-sentence investigative report prepared by the adult probation department on each defendant.David William Viars Jr., 35, Pottsville, entered guilty pleas to charges of delivery of a controlled substance, possession with intent to deliver, criminal use of communication system, and possession after making a sale at his home to a confidential informant. He was cited by Pottsville Cpl. Dennis G. Wiederhold.John Thomas Eavarone, 32, Northampton, entered a plea of nolo contendre (no defense) to a charge of failure to comply with registration requirements as a sexual offender by failing to notify authorities of a change of address. He was cited by Minersville Patrolman Jeffrey R. Bowers.Jennifer Tess Kramer, Pottsville, also entered a plea of nolo contendre to a charge of possession of a controlled substance filed by Pottsville Patrolman Joseph R. Welsh.Revoke probationFinding that the rules were violated Judge John E. Domalakes revoked the probation of Lisa Flowers, 39, of Shenandoah, and re-sentenced her on a charge of disorderly conduct to serve three to 12 months in the county prison and to undergo a drug and alcohol evaluation and follow up any recommended treatment.Flowers had pleaded guilty to the charge last October and was placed on probation. She was cited by Shenandoah Patrolman Robert Senape.Warrant hearingsBalinder Singh Mataru Jr., 42, Minersville, had the bench warrant which brought him to court dissolved by Judge Charles M. Mller and his bail was reinstated and he was released from prison.Mataru faces a charge of theft of leased property after allegedly failing to make payments on rental of a scaffold from Ark Rentals, West Brunswick Township. The charge was filed by Trooper Robert Oakley.Christopher Michael Turofski, Frackville, was brought in on a bench warrant and after a hearing Miller dissolved the bench warrant and revoked his bail and remanded him to the county prison pending resolution of his case.Turofski faces charges of burglary, theft, receiving stolen property, and unauthorized use of an all terrain vehicle (ATV) taken from the garage of Richard Harris, McKnight Street, also a television set. He was cited by Butler Township Patrolman Shawn Butler.Sher Afsar Khan, 65, Stroudsburg, had his bench warrant dissolved by Miller and bail reset at $10,000 unsecured with conditions he reside at 361 E. Ninth St., Brooklyn, N.Y., and cannot relocate without permission from the county district attorney and shall not travel outside the state of New York.Khan faces a charge of passing a bad check issued to Robert Kenesky, 642 E. Broad St., Tamaqua. He was cited by Patrolman Michael Hobbs.
