Carbon man given jail term after pleading in three cases

A Carbon County man was sentenced to a county prison term after entering guilty pleas in three pending cases last week.

Michael Fisher, 26, of Lehighton, was sentenced to a total of one day less one year to one day less two years by President Judge Roger N. Nanovic.Fisher pleaded to aggravated assault and criminal mischief for an incident on May 3, 2011, in Lehighton with Charles Swartz the listed victim. He pleaded to possession of drug paraphernalia for an incident on May 2, 2011, in Mahoning Township. He also pleaded to one count of driving under the influence (DUI) for an incident on April 15, 2011, along Blakeslee Blvd., in Lehighton. Given a test, the result was .13BAC.The jail term will be followed by three years of probation.Fisher was also ordered to get both a mental health and drug and alcohol evaluations, supply a DNA sample, make total restitution of $2,360.52, pay a fine of $500 for the DUI, and one year license suspension.He was given credit for 312 days spent in jail on the charges. He will begin the jail term at 8 p.m. on July 29.ARD placementLeo Thomas Fochtman, 25, of Lehighton, was placed in the county's Accelerated Rehabilitation Disposition (ARD) probation program for first time offenders, on a DUI charge.He was arrested on March 7 along Delaware Avenue in Palmerton by state police at Lehighton. Given a test, the result showed the presence of a controlled substance.He was placed for a year, assessed $600 for the cost of the program, ordered to get a D&A evaluation, and license suspended for 60 days.If he successfully completes the program his record will be wiped clean.Both defendants must also pay court costs, which average about $1,000, and pay a $50 per month supervision fee while on probation or parole.
