Probation/parole revocation hearings

The Carbon County court conducted probation/parole revocation hearings on petitions filed by the county adult probation office.

The petitions were filed against 12 defendants currently under supervision of the probation office for violating the terms of their probation/parole.Barry Tindula, 31, of Palmerton, had a petition filed by probation officer Kimberly Cooper for violating his probation on a theft count. He violated his conditions by testing positive for cocaine, opiates and suboxone and violated the zero tolerance condition.He did not contest the petition and was committed to the county prison by Judge Joseph J. Matika to serve out his maximum term, which runs to Oct. 9.Tyler Kistler, 25, of Lehighton, had a petition filed to revoke his probation filed by Cooper on a charge of driving under the influence (DUI). He violated the conditions by testing positive for opiates and violating the zero tolerance condition.He did not contest the petition and was recommitted to the county prison by Judge Steven R. Serfass to serve 45 days effective May 31 and consecutive to a probation sentence he is currently serving.Holly Koch, 20, of Palmerton, had a petition filed to revoke her parole and probation filed by Cooper for violating the conditions of testing positive for opiates and violating zero tolerance condition. She was previously sentenced on charges of burglary, corruption of minors, and theft.Serfass ordered her recommitted to the county prison to serve 45 days effective May 31, and consecutive to a probation sentence she is currently serving.Robert Schafer, 34, of Palmerton, had a petition filed to revoke his probation by Cooper for violating conditions of being arrested by Palmerton police on Feb. 2, arrested a second time by Palmerton police on May 17, and engaging in assaultive behavior on both occasions. He was previously sentenced on a simple assault charge.He did not contest the petition and was resentenced by President Judge Roger N. Nanovic to serve 89 to 177 days in the county prison effective May 20.Francis Filoreto, 27, of Sugarloaf, Luzerne County, had a petition filed to revoke her parole on a charge of criminal trespass filed by probation officer Joseph Burke for violating conditions.He did not contest the petition and was remanded to the county prison by order of Matika to serve 45 days effective June 11.Mary Hill, 42, of Lansford, had a petition filed by probation officer Clifford Eckhart, to be revoked from the county's Accelerated Rehabilitation Disposition (ARD) probation program for first time offenders on a DUI charge. She violated conditions by failure to pay court costs and fees, failed to complete the highway safety program, and failed to perform 50 hours of community service.Matika revoked her from the program and ordered the case placed on the November trial list. However, the revocation is deferred pending completion of the following by Oct. 16: she shall pay in full her court costs and fees, complete the highway safety program, and submit proof of 50 hours of community service. If she meets those requirements by the October date, the revocation order will be vacated.Crystal Heffelfinger, 31, of Lansford, had a petition filed by Eckhart to revoke her placement in the ARD program for violating conditions that she failed to pay in full court costs and fees and failed to perform 50 hours of community service. She was placed in the program on a false identification to law enforcement charge.Matika ordered the revocation of the ARD program effective Aug. 16 and placed the case on the pretrial list with conditions she must pay her court costs and fees by that date and complete her community service by then. If she does, the revocation order will be vacated.Michelle Canzoneri, 27, of Altoona, had her placement in the ARD program revoked by Matika for violating conditions of testing positive for a controlled substance, admitting to the use of the same, and violating the zero tolerance condition. She was placed in the program on a DUI of a controlled substance charge.Her case was ordered by Matika placed on the next pretrial list.Tara Hertzog, 29, of Nesquehoning, had a petition filed to revoke her parole by Eckhart on charges of possession of drug paraphernalia. She failed to complete a drug and alcohol treatment program.Nanovic recommitted her to the county prison to serve 110 back time days, effective May 17, with credit for 49 days already served.Karalyn Dietrich, 25, of Summit Hill, had a petition filed by Eckhart to revoke her probation on a possession of a controlled substance charge by violating conditions by testing positive for alcohol and violating the zero tolerance condition.Nanovic resentenced her to serve one to three months in the county prison effective Aug. 16 at 9 a.m. and pay a fine of $250. The order also states if there are no subsequent violations of standard and special conditions of the original order of sentence the revocation order will be vacated.Alisen Vanger, 24, of Tamaqua, had a petition filed by Eckhart to revoke her parole on a DUI charge for violating conditions of failure to report to the probation office as directed, absconded from her approved residence and her whereabouts were unknown, failed to engage in and complete alcohol highway safety program, and failed to engage in and complete alcohol/drug treatment program. Additional violations noted in the petition included new criminal charges being filed by Tamaqua police on Aug. 13, 2012, by Coaldale police on Aug. 28, 2012, and by Nesquehoning police on Sept. 25, 2012.Serfass revoked her parole and on July 1 recommitted her to the county prison to serve 98 days of back time.Bodean Boggs, 23, of Lansford, had a petition filed by Eckhart to revoke his parole on a possession of drug paraphernalia charge for violating condition that he did not perform 50 hours of community service.Serfass revoked his parole and recommitted Boggs to the county prison to serve 50 days back time effective Aug. 1 at 9 a.m. In the meantime, if he provides proof that the 50 hours of community service is completed, the sentence will be vacated.
