A Carbon County man entered guilty pleas in five pending criminals cases on Thursday in the county court. He was one of 16 defendants to enter pleas before Judge Joseph J. Matika.

ContrabandMichael J. McFadden, 24, of Nesquehoning, pleaded to a total of six criminal counts with the most serious being bringing contraband into the county prison.McFadden was arrested for the contraband count for an incident on Oct. 31, 2012, when he was brought to the jail on other charges and illegal drugs were found on him. The charge is a felony two.McFadden also pleaded to one count of theft from a motor vehicle and simple assault which occurred on Oct. 31 in Nesquehoning, the charge he was brought to the prison. He also pleaded to one count each of false identification to law enforcement and possession of drug paraphernalia for an incident on Oct. 25, 2012.He pleaded to one count of escape, rated a felony three, for an incident when he was furloughed from the county prison to enter the Salvation Army inpatient rehabilitation program at a facility in Philadelphia. He was booted out of the program for violating rules and did not return to the prison as required under the terms of the furlough.Matika told McFadden that based on his prior record score and the various charges, including two felonies, he faces a state prison sentence.Matika deferred sentencing and ordered the adult probation office to prepare a presentence investigation (PSI) report.Firearm possessionThruman Bradford Brown, 46, of Lehighton, pleaded to one count each of possession of a prohibited weapon and simple assault.He was arrested on Nov. 16, 2012, for an incident in Franklin Township. Police responded an area along SR2016 for a reported disturbance.On scene they found Brown in possession of a 30-30 rifle and allegedly that he threatened Scott Breiner with it. Police said the gun was loaded and he pointed the weapon at Breiner. Brown denied the gun was loaded and that he pointed at Breiner.Matika told Brown that he got a "tremendous break" when the district attorney's office agreed to drop the possession count to a misdemeanor rather than a felony. He said that saved Brown from a state prison term. Brown has a prior felony conviction which prohibits him from possessing a firearm.Matika sentenced him to serve nine to 23 months in the county prison on each count with the terms running concurrently.Brown was also ordered to get a mental health evaluation and follow any recommendation for treatment, and have no contact with the victim. He was given credit for 188 days spent in jail to date on the charges.Other pleasOther defendants entering pleas included:David Robert Roth, 26, of Palmerton, pleaded guilty to two counts of burglary, both felony ones. He was charged with entering two residents on Oct. 27, 2012, in Towamensing Township, and removing jewelry and other items then selling them in the Allentown area.Matika deferred sentencing so a restitution amount could be determined.Andrew Kaban, 27, of Jamaica, N.Y., pleaded to one count of possession of drug paraphernalia. He was arrested on March 10 by Summit Hill police at a checkpoint operation along White Bear Drive. He was a passenger in a vehicle stopped at the checkpoint operation.Matika placed him on probation for six months and ordered he render 25 hours of community service.Jose Juan Reyes-Maldonado, 33, of West Hazleton, pleaded to one count of possession of a controlled substance.He was arrested on Dec. 10, 2102, along Laurel St., by Weatherly police after he purchased prescription pills from a confidential informant (CI) working for the police. He was a passenger in a pickup truck when he made the purchase. Police stopped the truck after the purchase was made.Matika placed him on probation for a year and ordered he render 50 hours of community service, get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment, and zero tolerance imposed on D&A use.Alonzo E. Delrymple III, 39, of Freeland, pleaded to one count of criminal conspiracy-possession of a controlled substance. He was the driver of the pickup truck Reyes-Maldonado was in when he made the drug purchase.He was placed on probation for a year and ordered to render 50 hours of community service.Michael Bocina, 22, of Jim Thorpe, pleaded to one count of simple assault.He was arrested by Lansford police for an incident on Jan. 10 along W. Kline Avenue. He admitted assaulting Linsey Romig in her apartment where he was residing at the time.He was placed on probation for six months and ordered to render 25 hours of community service, attend and complete anger management counseling, and have no contact with Romig.Vickie Velena Turoscy, 55, of Palmerton, pleaded to one count of disorderly conduct, as a summary offense, with a charge of persistent disorderly conduct, a misdemeanor, dropped in a plea agreement.She was arrested for an incident on Aug. 24, 2012, at the Family Dollar Store by Palmerton police.Matika imposed a fine of $100.Kori Stephen Errichetto, 20, of Freeland, pleaded to one count of theft.He was arrested on April 18, 2012, by state police at Hazleton for removing checks belonging to the Wreckers Booster Club, from a mailbox in Lehigh Township, and then cashing them at a bank in Hazleton.He was placed on probation for six months and ordered to make restitution to the club for $105, render 25 hours of community service, get a D&A evauation, and must find fulltime employment within the probation period.Errichetto was previously placed in the county's Accelerated Rehabilitation Disposition (ARD) probation program for first time offenders for not making restitution and paying court costs.Timothy Manuel Morales Jr., 20, of Easton, pleaded to one count of retail theft.He was arrested on Dec. 3, 2012, for an incident at Boyer's Market by Lansford police. He took $20 worth of merchandise.He was placed on probation for a year and ordered to render 50 hours of community service, and not go on the market's property. The items were recovered so no restitution was ordered.DUI casesThe following defendants pleaded to driving under the influence (DUI) charges.Xavier Richard Morana, 20, of Hazleton, was arrested on July 14, 2012, along Plane St., by Weatherly police. Given a test, the result showed the presence of a controlled substance.He was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, get a D&A evauation, and zero tolerance on D&A use.He will begin the jail term at 9 a.m. on May 25. The sentence is consecutive to a term he is serving in Luzerne County.Tracey Perkins, 39, of Hazleton, was arrested on Dec. 28, 2012, along Plane St., by Weatherly police. Given a test, the result was .18BAC.She was sentenced to serve five days to six months in jail, a fine of $300, one year license suspension, get a D&A evaluation, and zero tolerance for D&A use.She will serve the five days beginning June 1 at 9 a.m. for three days; then June 15 at 9 a.m. for two days.Frederick R. Bryan II, 39, of Hazleton, was arrested on Feb. 22 along Broad St., by Beaver Meadows police. Given a test, the result showed the presence of heroin and cocaine.Sentencing was deferred.Jason D. Hettler, 36, of Lehighton, was arrested on July 20, 2012, along SR248 in Bowmanstown, by state police at Lehighton. Given a test, the result was .16BAC.Matika sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, render 25 hours of community service, get a D&A evaluation, and zero tolerance imposed on D&A use.He was given credit for five days spent in jail on the charge and immediately paroled.Benjamin F. Kunkel, 33, of Lansford, was arrested on Oct. 29, 2012, along SR209 by Nesquehoning police. Given a test, the result showed the presence of a controlled substance.Matika sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, render 50 hours of community service, and get a D&A evaluation. He is currently in prison on a probation violation. He will serve the DUI sentence when the probation term is completed.Rafael Santiago Romero, 26, of Hazleton, was arrested on March 8 along Broad St., by Beaver Meadows police. Given a test, the result showed the presence of a controlled substance.He was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, get a D&A evaluation, and render 25 hours of community service. On a speeding charge he was fined $61 and costs.He will begin the jail term at 10 a.m. on May 28.Each defendant sentenced must also pay court costs, which average close to $1,000, and pay a $50 per month supervision fee while on probation or parole.
