A Carbon County woman was sentenced to a state prison on Tuesday after previously pleading guilty to having sex with a young boy.

She was one of eight defendants who previously entered guilty pleas to be sentenced by Judge Joseph J. Matika.Sexual assaultKayla Pearl Ashner, 21, of Palmerton, was sentenced to serve 15 to 30 months in a state correctional institution on a charge of statutory sexual assault.Ashner was charged by state police at Lehighton with having a sexual relationship with a then 12-year-old boy while she was 19. The sexual encounters occurred in an area along W. Stagecoach Road, in Towamensing Township.It was noted that Ashner has learning disabilities and even when confronted by police about the incidents and the law, still didn't believe she was doing anything wrong. She also told investigators that the victim pursued the sexual encounters, but later admitted she pursued the boy.She told the court she now understands what she did was wrong.Assistant District Attorney Jean A. Engler asked Matika to impose a 20- to 40-month prison term noting the "tremendous break" Ashner received in the plea agreement in which several much more serious counts were dropped.Matika cut the requested jail term by five months stating he would give Ashner credit for her efforts in getting mental health counseling since her arrest.In addition to the prison term Matika ordered Ashner to render 100 hours of community service when released from prison, supply a DNA sample, get a mental health evaluation, have no contact with the victim or his family, and make restitution of $434.32 to the victim's compensation board. She was given credit for 34 days spent in jail on the charge and began the prison term immediately.Five casesMatthew D. Frederick, 20, of Palmerton, was sentenced to serve a total of 10 to one day less 24 months in the county prison followed by two years of probation after previously pleading guilty in five pending cases.The sentence imposed on charges of criminal conspiracy-theft, aggravated assault, possession of marijuana, criminal trespass, and theft from a motor vehicle.He was arrested by Palmerton police on the various theft counts for entries made to numerous vehicles during a time frame of December 2011 into February 2012. The assault count involved in an incident on Jan. 22, 2012, in which he assaulted Aaron Bizousky along Delaware Avenue.Matika also ordered Frederick to render 100 hours of community service when released on parole, get both a drug and alcohol (D&A) and mental health evaluations and follow any recommendations for treatment, zero tolerance imposed on D&A use, have no contact with any of his victims, supply a DNA sample, make total restitution of $81.50, and pay a fine of $100 on the possession of marijuana count.He was given credit for 149 days spent in jail on the charges.Other casesOther defendants sentenced by Matika were:Robert Charles Ahn III, 33, of Summit Hill, was sentenced to serve nine to one day less 24 months in the county prison on a charge of possession with intent to deliver a controlled substance-heroin.He was arrested by agents of the state Attorney General's office after selling heroin to undercover agents on at least three occasions in Lansford and Summit Hill.Ahn told Matika he sold the drugs to get money to feed his heroin addiction. Matika noted it was Ahn's second possession with intent to deliver conviction.Matika warned the defendant, "You come back again on such a charge and you'll be looking at a state prison term."Ahn was also ordered to render 100 hours of community service when released on parole, get both a D&A and mental health evaluations, zero tolerance on D&A use, and supply a DNA sample. He was given credit for 104 days spent in jail on the charge to date and was granted work release privileges.John Thomas Shubeck, 46, of Lansford, was sentenced to time served (21 days) to one year in jail on a charge of possession of a controlled substance. He was arrested by Nesquehoning police for an incident at the county prison.Shubeck reported to the prison on March 8 to continue serving a weekend sentence when correction officers found pills hidden in his tooth brush holder. At the time he was serving a 60-day term.Shubeck said he completed the 60-day term as he has been held in the jail since March 8 with the weekend term revoked.Matika also ordered him to render 50 hours of community service, and get a D&A evaluation.Tiffany Lee Binder, 30, of Lansford, was placed on probation for 18 months on a charge of receiving stolen property. She was arrested on Nov. 10, 2011, by Lansford police for taking a purse belonging to Lorraine Breslin, and removing various prescription medication from the purse.Binder said she spent 21 days in a inpatient rehabilitation program but left before completing it. She also said she has been drug "clean" for 112 days.Matika also ordered her to render 75 hours of community service, get a D&A evaluation, zero tolerance on D&A use, and make restitution of $458.61.James M. Duffy, 34, of Beaver Meadows, was sentenced on a driving under the influence (DUI) charge. He was arrested on Sept. 15, 2012, along Main Street, by Weatherly police, after being involved in an accident. Given a test, the result was .25BAC.He was sentenced to serve 48 hours in the county prison, then 28 days in the Intermediate Punishment Program (IPP) with electronic monitoring, followed by five months probation. He must also pay a fine of $750, one year license suspension, render 50 hours of community service, get a D&A evaluation, zero tolerance on D&A use, and make restitution of $1,437.56 for damages caused in the accident.He will begin the jail term at 4:30 p.m. on May 24.Victor Alfredo Mateo, 24, of Hazleton, was sentenced on a DUI count. He was arrested on Oct. 25, 2012, along Laurel Street, by Weatherly police.He was sentenced to serve 30 days in the county prison followed by 23 months in the IPP with 16 months with electronic monitoring. He must also render 100 hours of community service, zero tolerance imposed on D&A use, $1,500 fine, and 18-month license suspension. He will serve the 30 days in the Carbon prison and the IPP in Luzerne County.He will begin the jail term at 9 a.m. on May 24.Deborah Gay Brown, 52, of Souderton, Montgomery County, was placed on probation for two years on a retail theft charge, her fourth conviction. She was arrested on Jan. 1, 2012, at Redner's Warehouse Market by Nesquehoning police for taking items valued at $9.84.She was also ordered to render 50 hours of community service, get a D&A evaluation, and supply a DNA sample.The term runs consecutive to a probation violation term she is currently serving in Montgomery County.Each defendant must also pay court costs, which average close to $1,000, and pay a $50 per month supervision fee while on probation or parole.
