McAdoo man gets jail term for theft from area coal firm

A McAdoo man pleaded guilty to theft from a Tamaqua area coal company and with 12 other defendants, who pleaded guilty to various criminal charges, were sentenced in the Schuylkill County Court by Judge John E. Domalakes as follows:

Stephen Frederick Davis, 38, of 416 S. Cleveland St., criminal conspiracy with an accomplice to commit theft of property of Mazaika Coal Company, Tamaqua, was sentenced to serve three to 23 months in the county prison beginning Monday, July 30, at 9. a.m. with credit for serving 50 days in prison, pay $50 to Criminal Justice Enhancement Account (CJEA) fund, is eligible for work release, and shall make restitution with Brian Viecheck and Chastiy Yanetti, co-defendants, of $12,635.10 to the coal company. Davis was cited by Rush Township Cpl. Duane Frederick, on July 12, 2011.Bryce Beaver, 37, Shenandoah, simple assault and recklessly endangering Stephanie Grant and Tristan Weyman, was sentenced to serve 25 days to 11 months in the county prison, and pay $50 to CJEA fund. Beaver was cited by Shenandoah Patrolman Christopher Zuber, on June 27, 2011.Michael Anthony Eckert, 21, Minersville, receiving property stolen from 470 Lewis St., Minersville, of a rifle and $2,000 in coins belonging to Joseph Thompson, was placed on probation 23 months, and pay $50 to CJEA fund. Eckert was cited by Minersville Patrolman Jeffrey Bowers, last Oct. 12.John Joseph Luback Sr., 45, Minersville, possession of a controlled substance and drug paraphernalia, was sentenced to serve 18 months on probation, pay $300 to Substance Abuse Eduction (SAE) fund, $50 CJEA fund, and make restitution of $113 to Bethlehem Regional Lab. Luback was cited by Minersville Patrolman Jeffrey R Bowers, last Aug. 16.Timothy Dale Magni, 39, Cleona, Lebanon County, DUI of drugs, was sentenced to serve 72 hours to six months in the county prison, fined $1,000, pay $100 to SAE fund, $50 to Catastrophe fund, make restitution of $60 to Schuylkill Medical Center, attend alcohol highway safety school, and driver's license suspended 12 months. Magni was cited Trooper Jeffrey Hummel last Sept. 9 when stopped on SR501 in Pine Grove Township.Courtney Ann Mengel, 37, Port Clinton, DUI of alcohol, was sentenced to serve five days to six months in the county prison, fined $300, pay $100 to SAE fund, $50 to Catastrophe fund, make restitution of $60 to Schuylkill Medical Center, attend safety school, and driver's license suspended 12 months. He must also install ignition interlock on vehicle for 12 months. Mengel was cited by Trooper Thomas T. Curtis, Jr. on July 1, 2011, when stopped on Center Turnpike (SR61) in West Brunswick Township.Rodney Alfred Snyder, 51, Schuylkill Haven, resisting arrest and assaulting two police officers, was placed on probation 23 months, and pay $50 to CJEA fund. On a charge of public drunkenness was fined $25. Snyder was cited by Schuylkill Haven Patrolman Warren G. Firing, on July 15, 2011.Joseph Thomas Tarlecky, 37, Oak Ledge Drive, North Manheim Township, simple assault on Richard Osatchuck, was sentenced to serve one week to 12 months in the county prison beginning Tuesday, Aug. 28, at 9 a.m., may participate in work release and is to be paroled after serving minimum sentence, also pay a fine of $100, pay $50 to CJEA fund, and shall make restitution of $2,163.65 to the victim. Tarlecky was cited by Trooper Michael S. Allar last Sept. 18.John Michael Vidzicki, Mahanoy City, DUI of drugs, serve six months on probation. On a charge of possession of drug paraphernalia, serve 12 months on probation for total of 18 months on probation, fined $300, pay $100 to SAE fund, $50 to MCARE fund, make restitution of $60 to Schuylkill Medical Center, complete safety school, undergo outpatient substance abuse counseling, and perform 10 hours of community service. No suspension of license was imposed.On a summary charge of driving an unregistered vehicle was fined $75; and driving a vehicle without an official inspection certificate fined $25 plus $100 in costs. Vidzicki was cited by Tamaqua Patrolman Peter Wysochansky, on June 27, 2011.Randy Williams, 25, Pottsville, simple assault and recklessly endangering Lauren Markovich was given credit for serving 48 days in the county prison and released on parole for 17 months, pay $50 to CJEA fund, and make restitution of $2,961 to the victim. Williams was cited last November by Pottsville police.Joseph Philip Zimmerman, 27, Valley View, Hegins Township, theft of lost or mislaid property was fined $25 plus $50 costs and make restitution of $604.24 to Donald Dress, owner. The ladder was left at the base of a billboard sign along SR61 in West Brunswick Township. Zimmerman was cited by Trooper Chad M. Smith.Tracy Ann Wensel, 39, Pottsville, two counts of delivery of a controlled substance in Pottsville, sentenced to serve two to 23 months in the county prison beginning Tuesday, Aug. 21, at 9 a.m. with credit for having served 15 days, pay $600 to SAE fund, $100 to CJEA fund, perform 20 hours of community service, make restitution of $226 to Bethlehem Regional Lab, and $30 to Pottsville Police Drug Task Force.Marcos Miranda, 60, Mahanoy City, DUI of alcohol, sentenced to serve a 10 days in the county prison and then placed in the Intermediate Punishment Program (IPP) on probation for five months and 20 days, fined $750, pay $100 to SAE fund, $100 to Catastrophe fund, complete safety school, receive intensive outpatient substance abuse treatment, perform 20 hours of community service, make restitution of $60 to Schuylkill Medical Center, driver's license suspended 12 months, and must install ignition interlock on car for 12 months. Miranda was cited by Rush Patrolman Peter Wysochansky, last Oct. 16.Each defendant must also pay a $50 per month supervision fee while on probation or parole.
