Four area residents among 23 to enter guilty pleas

Four area residents were among 23 who entered guilty pleas to criminal charges and were sentenced by President Judge William E. Baldwin in Schuylkill County court recently.

Dustin Ryan Hill, 22, of Hunter St., Tamaqua, on a charge of driving under the influence (DUI) was sentenced to serve 30 days to six months in the county prison, fined $750, pay $100 to Substance Abuse Education (SAE) fund, $50 to Criminal Justice Enhancement Account (CJEA), and submit to random screen tests. On a summary charge of careless driving was fined $25 plus $50 costs. Hill was cited by Trooper Joseph Aponick when stopped last June 14 on Interstate 81 in Kline Township.Charles Samuel Williams, 47, of 517 N. Railroad St., Tamaqua, on two DUI charges was sentenced to serve six months to five years in the county prison with the sentence beginning Monday, Feb. 27, at 9 a.m. He also must pay fines totaling $3,000, pay $600 to SAE fund, $200 to Catastrophe fund, $100 to CJEA, $120 to Schuylkill Medical Center and receive outpatient treatment.On a summary charge of careless driving was fined $25 plus $50 costs. Williams was first cited by Trooper Joseph Aponick on July 24, 2010, in Brandonville and by Mahanoy City Patrolman Charles Kovalewski, on Oct. 16, 2010.Nicholas James Garulle, 21, of 1018 Barnesville Drive, Barnesville, on a charge of receiving an all-terrain vehicle (ATV) stolen from the property of Joseph Barrett, Hellertown, was sentenced to serve four to 23 months in the county prison with the sentence to begin Tuesday, March 6, at 9 a.m., and perform 10 hours of community service. He was cited by Ryan Township Patrolman Adam Sinton, last Sept. 11.Bonnie Theresa Shigo, 27, of 419 E. Grant St., McAdoo, on a charge of retail theft from Fegley's Mini Mart, McAdoo, was placed on probation 18 months to begin at the expiration of an 18 months probation now serving since November 2010 for retail theft at Walmart Store in Rush Township.She also must pay $50 to CJEA, and make restitution of $19.43 to the store. Shigo was cited by McAdoo Patrolman Shawn Kistler, last May 20.Randy Jarred Ratliff, 40, Gilberton, on a charge of DUI was sentenced to serve 135 days to five years in the county prison with the sentence to begin Thursday, March 22, at 9 a.m., fined $1,500, pay $100 to the SAE fund, $50 to CJEA, and submit to random screen tests.On summary charges of driving while his operating privileges were suspended was fined $200 and for violating a stop sign fined $25 plus $100 costs. He also must make restitution of $500 to Carolyn Yackera and $3,647.78 to Alliance Insurance Company after being involved in an accident. Ratliff was cited by Girardville Patrolman Peter Wosochansky, on May 10, 2010.Dean Ray Simmons, 48, Pottsville, on a DUI charge was sentenced to serve 72 hours to six months in the county prison beginning Friday, March 2, at 9 a.m., fined $1,000, pay $300 to SAE fund, $50 to CJEA, $60 to Schuylkill Medical Center, and perform 10 hours community service.On a summary charge of driving while his operating privileges were suspended was fined $200 plus $50 costs. Simmons was cited by Pottsville Patrolman James P. Englert, last Sept. 11.William Perry Sims, 30, Reading, on a charge of possession of drug paraphernalia when stopped on the Seltzer Highway by Minersville Patrolman Richard C. Clink, on Aug. 5, 2010, was given credit for serving three days in the county prison and was released on probation 23 months, pay $100 to the SAE fund, and make restitution of $172.02 to the Schuylkill County Drug Task Force.Aaron Patrick Stevens, 25, Robinson Road, Mahanoy Township, on charges of possession a controlled substance, possession of a small amount of marijuana and drug paraphernalia was placed on probation 12 months, pay $100 to SAE fund, $50 to CJEA, and perform 20 hours of community service. He was cited by Mahanoy Township Officer Brandon Alexander, last April 23 at his home. He is currently serving 18 months on probation since Feb. 2, 2011, for possession of drugs and theft charges.Mark E. Hencheski, 31, West Hazleton, on charges of possession of a controlled substance and drug paraphernalia was placed on probation 12 months, pay $100 to SAE fund, $50 to CJEA, perform 10 hours of community service and make restitution of $113 to Bethlehem Regional Lab. He was cited by Mahanoy City Cpl. Michael Dissinger, last June 6 on East Railroad Street.William Smith, 30. Ashland, on a charge of escaping from sheriff deputies who took him into custody on a bench warrant and resisting arrest was given credit for serving two days in the county prison and released on parole for 35 months, pay $50 to CJEA, and perform 10 hours of community service.Luis Anton Guadalupe, 25, Pottsville, pleaded guilty to charges of possession with intent to deliver a controlled substance, possession of a controlled substance and possession of drug paraphernalia in his home last June 31. He was cited by Pottsville Patrolman Brian W. Kotzmoyer. Sentencing was deferred to a later date.Tyree Hasson Thomas, 24, an inmate at the state correctional facility in Ryan Township, on four counts of aggravated assault of police officers was sentenced to serve two and 1/2 to five years in a state correctional facility, pay $50 CJEA and make restitution of $268 to Joshua Mackey. He was cited by Trooper John Powis.Desemer Joseph Marshall, 38, Pottsville, on charges of possession with intent to deliver a controlled substance in the 400 block of Baber Street, Pottsville, was given credit for serving 43 days in the county prison and was released on parole for 23 months, pay $100 to SAE fund, perform 10 hours of community service and make restitution of $113 to Bethlehem Regional Lab. He was cited by Patrolman Brian W. Kotzmoyer, last Aug. 8.Charles Anthony Palina, 23, Pottsville, on a charge of criminal mischief to a heavy equipment machine at Salem Hill Job Site on property of Rich Coal Company was placed on probation 11 months, pay $100 to SAE fund, $50 to CJEA, perform 10 hours community service and make restitution of $6,198 to the coal company. He was cited by Port Carbon Patrolman Joseph C. Ferraro, on May 15, 2010.William Lloyd David, 23, Pottsville, on a charge of possession of a small amount of marijuana when stopped by Pottsville Patrolman Joseph J. Krammes, last Aug. 9 in the 200 block of Mahantongo Street, was placed on probation 30 days, pay $100 to SAE fund, $50 to CJEA, and make restitution of $113 to Bethlehem Lab.Jason Gar McNitsky, 38, Schuylkill Haven, on a DUI charge was sentenced to serve 48 hours to six months in the county prison, fined $500, pay $100 to SAE fund, $50 to CJEA, perform 10 hours community service, make restitution of $180 to Schuylkill Medical Center, and $113 to Bethlehem Regional Lab.On a charge of possession of a drug paraphernalia received a 12 months concurrent sentence. He was cited by Schuylkill Haven Patrolman David T. George, last July 4. McNitsky also pleaded guilty to criminal trespass on property at 611 Fairview Street, Pottsville, last March and was given a concurrent 12 months probation sentence and ordered to make restitution of $290 to Heidi Lengle for damages caused by breaking into the building.Brian Keith Lockett, 48, Saint Clair, on a DUI charge was sentenced to serve 90 days to five years in the county prison with credit for having served 77 days in a rehab center, fined $1,500, pay $300 to SAE fund, $50 to CJEA, $200 to Catastrophe fund, $60 to Schuylkill Medical Center, and received outpatient treatment. He was cited by Saint Clair Sgt. William Dempsey.William J. Zulkowski, 40, Pottsville, on charges of retail theft and resisting arrest was sentenced to serve seven to 23 months in the county prison and make restitution of $51 to Redner's Market, Shenandoah, and $339 to Bethlehem Regional Lab. He received credit for serving 232 days in prison. On a criminal mischief charge was fined $25 plus $50 costs. He was cited by Shenandoah police.Scott Bradley Haluska, 38, Schuylkill Haven, pleaded guilty to two retail theft charges and was sentenced to serve one to two years in a state correctional facility (he has a prior record of two retail theft convictions), and must make restitution of $379.98 to Boscov's Store, Fairlane Village Mall, Pottsville. He was cited by Trooper Todd W. Heinz.Sarah Elizabeth Werner, 25. Pottsville, on a charge of making a false report to police of stolen property was placed on probation 12 months, pay $50 to CJEA, and perform 10 hours of community service. She was cited by Pottsville Patrolman Joseph F. Murton, to whom she told a television set was stolen which showed up in a pawnshop.Alan Tyrone Lyles, 31, inmate at the state correctional facility in Ryan Township, on a charge of indecent assault of a counselor at the prison was sentenced to serve one to two years in a state correctional facility and the sentence is to begin at the expiration of a sentence now serving imposed by Allegheny County Court.Leanne Micklesavage, 24, Mount Carmel, on a charge of criminal conspiracy to obtain drugs from a pharmacy in Ashland was sentenced to serve three to 23 months in the county prison with credit for serving 48 days and make restitution of $172 to Bracey's Pharmacy. She was cited by Patrolman Daniel Weikel III.Brooke Elizabeth Evitts, 23, Pottsville, on a charge of theft was placed on probation 12 months, and pay $50 to CJEA. She was cited by Pottsville Patrolman Joseph H. Murton.Each defendant must also pay a $50 per month supervision fee while on probation or parole.
